The Contracting Authority, taking into account that the completion of the contract will take place after 01.01.2026, informs that it will reject the tender as inconsistent with the terms of the contract on the basis of Art. 1 point 5 of the Public Procurement Act, which offered a switchgear for the primary separation of the SC using an insulating medium in the form of fluorinated greenhouse gases (including SF6), because on the date of acceptance of the construction works it will not be able to introduce such a device for use in accordance with Article 13 sec. Regulation (EU) 2024/573 of the European Parliament and of the Council of 7 February 2024 on fluorinated greenhouse gases, amending Directive (EU) 2019/1937 and repealing Regulation (EU) No 517/2014 (https://eur-lex.europa.eu/eli/reg/2024/573/oj?locale=en). At the same time, the Ordering Party informs that it will reject the offer as inconsistent with the terms of the contract on the basis of Art. 1 point 5 of the Public Procurement Act in the event of failure to indicate in the Offer Form the type of insulation medium within the scope of the switchgear of the original type of the SC. The detailed description of the subject of the contract is contained in the project documentation constituting Annex No 12 to the FTZ and the STWiORB constituting Annex No 17 to the FTZ. The contracting authority requires that the subject of the contract be carried out in accordance with the guidelines indicated in these documents (Annex No 15 to the FTZ) and the instructions and standards annexed to the FTZ (Annex No 16 to the FTZ) and the draft provisions of the contract (Annex No 13 to the FTZ).
