Description

1. The subject of the contract is the purchase of AMPED FIVE software with a 6-year license and the purchase of PASSWARE KIT Ultimate software with a 6-year license. The contract is financed by the Internal Security Fund for 2021-2027, as part of the project ‘International police cooperation – strengthening the capacity of the EU Police to prevent and fight organised crime’. 2. The proceedings are divided into two separate parts: 1) Lot 1 – the purchase of AMPED FIVE software with a 6-year license, 2) Lot 2 – the purchase of PASSWARE KIT Ultimate software with a 6-year license.’ 3. The detailed description of the subject-matter of the contract is set out in Annex 1 to the tender specifications – Description of the subject-matter of the contract and Annex 3 to the tender specifications, hereinafter referred to as ‘SWZ’ – Draft provisions of the contract. 4. The assortment offered by the Contractor must meet all the requirements of the Ordering Party specified in the FTZ with attachments. 5. Equivalence. 1) If the description of the subject of the contract uses signs or parameters indicating a specific manufacturer, a specific product or indicates trademarks, parameters or origin, the Ordering Party allows the use of equivalent products, which should be understood as products with parameters not inferior to those presented in the description of the subject of the contract, meeting the requirements of the Ordering Party. It is the Contractor's responsibility to prove the equivalence of the product. 2) Due to the specificity of the subject of the contract, the Ordering Party cannot describe the subject of the contract without referring to the proprietary names of the software. Contractors may provide equivalent solutions, by which the Ordering Party understands the solution as the same or better than the usable and desirable solution, in particular in terms of ensuring the objectives of the update, functionalities characterizing the desired solution, compatibility with hardware and software functioning at the Ordering Party. If an equivalent solution is offered, the Contractor must demonstrate its equivalence to the subject-matter of the contract.
