The contractor shall notify the contracting authority in writing, by fax or e-mail of the availability of the vehicles for acceptance and the place where they are prepared for visual inspection. Within 7 days of receipt of this information, the contracting authority may verify on-the-spot that the vehicles comply with the requirements of the specifications and may notify within the same period that vehicles must be delivered without visual inspection to Kraków.
Cars are registered by MPWiK SA on the basis of a set of documents provided by the contractor. The collection of the cars from the contractor (loco Kraków) is carried out by the Plenipotentiary of the Management Board. Transport management or other authorised representative of MPWiK SA after signing a handover and acceptance report confirming that the cars have the required equipment and that the required documents for their registration have been attached. In the absence of the required documents for the registration of vehicles, the acceptance report shall not be signed. If irregularities are found in the attached documents preventing receipt, the contractor will pay a contractual penalty.
2. The contractor may, instead of the certificates, attestations, certificates and opinions specified in the specifications (as annexes to the tender or subsequently required) submit equivalent certificates issued by entities established in another Member State of the European Economic Area, if the applicable rules do not require documents issued exclusively by the Polish institution.
3. In view of the specific nature of the subject matter of the contract pursuant to Article 36(1). 5 of the Act, the contracting authority does not allow any part of the scope of the contract to be subcontracted.
4. The minimum guarantee period required shall be: 36 months for varnishes, 72 months of anti-perforation guarantee, 24 months’ contractual guarantee for the entire order from the date of acceptance of the subject-matter of the contract. Where different guarantee periods are granted, the shortest of the guarantee periods offered will be used to assess whether this condition is met. The duration of the guarantee should be clearly indicated in months and not in moto-hours (MTH).
