Description

1. Subject-matter of the contract: Surgical instruments and meshes described in detail in Annex 2 to this SWZ - individual packages. 2. Scope of the subject of the contract: The goods offered by the Contractor must: a) comply with Polish standards transposing European standards or standards of other Member States of the European Economic Area transposing these standards. b) have valid documents allowing for marketing in the territory of the Republic of Poland in accordance with the provisions of the Act of 7 April 2022 on medical devices, its transitional and implementing provisions and Regulation (EU) 2017/745 on medical devices - MDR (if the law imposes the obligation to have such documents) - if it concerns a given product, c) meet the requirements specified by the Ordering Party in the Specifications of the Order Conditions, in particular the conditions specified in the description of the subject of the contract. 3. The Contractor shall provide up-to-date documents confirming that the offered subject of the contract complies with the Medical Devices Act of 7 April 2022 and is authorised for marketing and use in the healthcare sector (CE certificates/declarations of conformity) in accordance with the class of medical device or a relevant statement that the provisions of the aforementioned Act do not apply to a given product, together with other documents confirming that the product is authorised for marketing and use in the European Union, when their submission is necessary on the basis of separate provisions - together with the first delivery and if they are updated during the term of the contract. 4.
