Description

The performance of this contract involves the performance of the following groups of activities: (a)Design and preparation of work projects (including geodetic surveying of the adjacent terrain and additional surveys – only if necessary); b) Performing construction and installation activities prescribed in the approved investment project and c) Carrying out author's supervision by the designers who have prepared the technical projects, in this regard the CONTRACTOR is responsible for: 1. Preparation of an investment project in the ‘Working’ phase for the site, in scope and content in accordance with Ordinance No 4 of 21 May 2001 on the scope and content of investment projects, Ordinance No RD-02-20-2 of 20 December 2017 on the planning and design of the communication and transport system of urban areas, the laws and regulations of the Republic of Bulgaria and in accordance with the requirements of the Contracting Authority; 2. Carrying out all necessary activities for coordination of the investment project with the Contracting Authority, central and territorial administrations, specialized control bodies and operating companies on behalf of the Contracting Authority; 3. Reflection of the recommendations and observations made in the course of the coordination procedures carried out by the Contracting Authority with central and territorial administrations, specialized control bodies and operating companies, and of the assessment of the compliance of the investment project with the basic requirements for the construction works by the Consultant; 4. Obtaining all the necessary opinions and permits necessary for carrying out his work, according to the Bulgarian legislation; 5. Legal, quality and timely start, execution and completion of the construction, including delivery of construction products, mechanization, workforce and any services and activities necessary for the execution of the construction in accordance with the technical specifications and investment projects, in accordance with the Spatial Development Act (SDA) and the secondary normative acts for its implementation, all other normative documents in force and the Public Procurement Contract; 6. Timely drafting of acts and protocols during construction in accordance with the requirements of Article 163(2)(3) of the Spatial Development Act; 7. Preservation and provision upon request by the other participants in the construction or by a control body of the construction papers, the order book of the construction under Art. 170, para. 3 of the Spatial Development Act, the acts and protocols drawn up during the construction and other technical documentation for the execution of the construction; 8. Author's supervision during construction in volume and content in accordance with the Spatial Development Act and the secondary normative documents for its implementation; 9. Preparation of executive documentation in accordance with Article 175 of the Spatial Planning Act and cadastral surveys of the site within the scope necessary to fulfil the obligations of the Contracting Authority arising from Article 54a(2) of the Cadastre and Property Register Act; 10. Removal of any defects found within the warranty period; 11. When the contract is concluded and during its term, ensure that at least 70% (by weight) of the non-hazardous construction and demolition waste (excluding naturally occurring materials referred to in category 17 05 04 in the European List of Waste established by Decision 2000/532/EC) (including the incineration or dumping of waste, excluding the incineration of non-recyclable hazardous waste) generated on the construction site is prepared for reuse, recycling and other material recovery, including backfilling operations using waste to replace other materials, in accordance with the waste hierarchy and the EU Construction and Demolition Waste Management Protocol; 12. In carrying out the work, ensure that the construction components and materials used do not contain asbestos or substances of very high concern, as determined on the basis of the list of substances subject to authorisation set out in Annex XIV to Regulation (EC) No 1907/2006; 13. In carrying out the work, take measures to reduce the emissions of noise, dust and pollutants; 14. Fulfilment of administrative requirements under the applicable legal framework.
