1. Contracting authorities described in Chapter I SWZ jointly conduct a public procurement procedure (Article 38 of the Public Procurement Act). The contracts will be awarded (signed contracts for the supply of electricity) by the contracting authorities described in Chapter XVIII of the SWZ. 2. The subject of the contract is the supply of electricity in the period from 01.01.2025 to 31.12.2025. The contract will be awarded in two parts. The Contractor may submit a tender for any number of parts: 1) Lot 1 of the contract – Supply of electricity to premises and facilities. 2) Lot 2 of the contract – Supply of electricity for road lighting. A detailed description of the individual lots can be found in Chapter III.1, III.2 of the SWZ. 3. The estimated amount of electricity to be procured is indicative and may differ from the amount actually consumed during the term of the contract. The amount of electricity was estimated on the basis of historical data on electricity consumption in the last 12 months and taking into account the actions taken by the procurers referred to in Article 37 of the Act of 7 October 2022 on special solutions for the protection of electricity consumers in 2023 in connection with the situation on the electricity market. The Contractor must take into account possible fluctuations in electricity consumption. Reducing or increasing the amount of electricity does not entail any consequences for the contracting authorities (customers) other than the need to pay for the amount of energy actually consumed. 4. Detailed description of the subject of the contract Part 1 of the contract - Supply of electricity to premises and facilities. 1. Right of option – Municipality of Radomin 1) Under the basic contract, supplies to PPE 590243895023907363 (on which the contracting authority plans to install PV installations and obtain the status of Prosumer) will be carried out until 30 September 2025. 2) Under the option right, the contracting authority reserves the right to extend the supply of electricity to PPE described in point 1 until 31.12.2025 at the latest. 3) The right of option will apply if the contracting authority does not install and connect the photovoltaic installation in time to start providing the comprehensive service for Prosumer (for PPE described in point 1) no later than on 01.10.2025. 4) As a result of exercising the option right, the volume of purchased energy may be increased by a maximum of 31.47 MWh, i.e. in the case of exercising the option for PPE in the maximum period, i.e. from 01.10.2025 to 31.12.2025. (detailed description – Annex 1c to the SWZ) 5) The contracting authority will exercise the option by submitting to the contractor, no later than 30 days before the planned date of commencement of deliveries (i.e. by 28 August 2025), a declaration of exercise of the right (indicating the EPP point, the delivery period under the option and the volume) signed by the authorised person. The declaration will be submitted in writing or in electronic form (electronic form with a qualified signature) to the contractor's mailing address or e-mail address indicated in the Electricity Sales Agreement. 6) The conditions for exercising the option right are described in Annex 8a to the SWZ (draft provisions of the electricity sale agreement). 7) The exercise of the right of option is a right of the contracting authority and not an obligation towards the contractor. 9. As a result of the proceedings, 16 contracts will be concluded. III.2. Detailed description of the subject-matter of the contract — Lot 2 — Supply of electricity for road lighting. 1. The subject of the contract is the supply of electricity with an estimated volume of 1 010.30 MWh. The data are indicative. 2.
