1) The subject of the contract includes: a) collection and management (recovery or disposal) of municipal waste from owners of residential real estate (including real estate that is partly real estate on which residents live, and partly real estate on which residents do not live) in the Lubaczów Commune in a way that ensures the achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and the reduction of the weight of biodegradable waste sent for storage, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws No. Journal of Laws 2024, item 399) and implementing acts, as well as the provisions of the Waste Management Plan for the Podkarpackie Voivodship valid during the performance of the contract and provisions of local law, in particular specifying the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, regulations for maintaining cleanliness and order in the Lubaczów Commune. From owners of residential properties on which waste is generated, any amount of municipal waste exhibited in front of the property will be collected and managed, i.e.: unsegregated (mixed) municipal waste together with the collection of mixed waste is allowed to collect ash in bags from single-family properties, separately collected municipal waste (i.e. plastics, multi-material packaging, metal glass, paper and cardboard) and bio-waste with the proviso that bio-waste arising on the property built up with a single-family residential building will not be collected from the owners of these properties who declared composting bio-waste and benefit from the relief for this. bulky waste, waste electrical and electronic equipment, textiles and clothing (the so-called mobile mobile collection of waste from the property of owners of inhabited properties). b) Collection and management of waste from the Selective Municipal Waste Collection Point (PSZOK) located in the sewage treatment plant in Załuże 361 delivered by owners of properties inhabited from the Lubaczów commune. The export of mixed and separated waste will take place in accordance with the rules set out in the Regulations for the maintenance of cleanliness and order in the Lubaczów Commune adopted by Resolution No XXIII/238/2020 of the Lubaczów Commune Council of 29 September 2020 on the adoption of the Regulations for the maintenance of cleanliness and order in the Lubaczów Commune, as amended, constituting Annex 9 to the SWZ and Resolution No XLI/470/2022 of the Lubaczów Commune Council of 4 March 2022 on defining the detailed method and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, as amended, constituting Annex 9a to the SWZ. 3) The collection and management of waste from the Municipal Selective Waste Collection Point (PSZOK) will take place in accordance with the rules set out in Order No 47/2020 of the Mayor of the Lubaczów Commune of 4 May 2020 on the creation of a Municipal Selective Waste Collection Point and giving it regulations as amended – constituting Annex 9b to the SWZ. The detailed description of the subject of the contract is contained in Annex 1 to the SWZ; 1) The Ordering Party reserves the right to increase or decrease the number of properties served in the field of municipal waste collection. A change in the number of properties served will not result in a change in the contract or change in the value of the contract; 2) Hierarchy of waste management methods in accordance with the Waste Act, the relevant resolution of the Podkarpackie Provincial Assembly and resolutions of the Lubaczów Municipal Council. 1.1.
