Description

The contracting authority needs to procure a parallel framework agreement with up to two (2) tenderers for covering 24 hour residential and welfare services for users with resource demanding services in Sandnes kommune, provided that there are two (2) suitable tenderers and tender offers. The service is pursed in the Act 24 June 2011 no. 30 on municipal health and welfare services; • § 4-1 on prudence § 3-1 on the municipality ́s overall responsibility for health and care services. • 3-2 no. 6 letter c. place in an institution, including a nursing home. Act 2 July 1999 no. 63 on patient and user rights; § 2-1 on the right to necessary help from the municipality ́s health and welfare service. as well as special legal basis, including legal judgement from the courts. The service is awarded to adult users with a large and complex facilitation need with different types and intensity of disabilities such as, for example, but not limited to mental disabilities, mental disorders, physical disabilities, developmental disturbances, challenging behaviours or a combination of them. The contracting authority draws attention to the fact that in some cases users with drug and alcohol challenges can present. The framework agreement also applies for individual users with special needs as far as applicable. Special needs can include medicament challenges, infectious considerations and a need for special competence etc. In cases where the special need does not fit the framework agreement, the contracting authority reserves the right to procure services outside the contract. The aim of the procurement is to ensure users quality approved services when the contracting authority does not have the capacity to meet the needs of self-management. Returning to the municipality is a general goal and the tenderer shall actively contribute in facilitating the return. The extent of the framework agreement can, therefore, vary considerably from year to year.
