The contract was awarded in accordance with Section 14(4)(2)(b) and (6) VgV because, for technical reasons, the contract could only be performed by Oracle and there are no reasonable alternatives or substitute solutions. DRV KBS operates a complex IT landscape whose technical basis includes an IBM mainframe with central applications, including a document management system for core areas of KBS. Oracle Java is used as a development platform especially in the pension insurance environment within the DRV KBS IT landscape. The technology is required to operate the IBM Content Manager document management system on the mainframe. In this area, it is not possible to switch to an alternative JAVA derivative at short notice, because IBM does not currently support the JAVA standard (RedHat Java) set within the DRV. The procurement requirement technically requires the Oracle Java SE Universal Subscription, which is technically only offered by ORACLE.
