1. The subject of the contract is the successive supply of specialist reagents for scientific research at the Institute of Animal Reproduction and Food Research of the Polish Academy of Sciences in Olsztyn. A detailed description of the subject of the contract can be found in the tender form – Annex 1 to the SWZ. In the present proceedings, the contracting authority did not allow partial tenders to be submitted on account of the uniform subject-matter of the contract. Each Contractor may submit one tender. 2. The Contractor shall supply the products accompanied by safety data sheets and/or quality specifications containing the basic data and the physical and chemical requirements confirming the conformity of the products supplied with the RTS. 3. The term of the guarantee granted for products may not be shorter than 75% of the standard term offered by the manufacturer, counting from the date of its delivery, in accordance with the term offered by the Contractor in the offer. The guarantee period is one of the criteria for the evaluation of tenders. The procedure for checking and confirming the compliance of the delivered order and the method of submitting complaints in accordance with the provisions of Annex 3 – draft provisions of the contract. 4. The contract with the Contractor will be concluded for a period of 18 months. The partial delivery date will be consistent with the date offered by the Contractor in the offer: up to a maximum of 35 days from the date of placing the order by the Ordering Party. The delivery date is one of the criteria for the evaluation of offers. 5. PROVISIONAL MEASURES IN QUESTION: a. The Contracting Authority requires the Contractor to submit together with the tender safety data sheets of the offered products and/or a quality specification containing basic data and physical and chemical requirements confirming that the offered products meet all the requirements of the Contracting Authority indicated in the description of the subject of the contract. b. The Contractor shall submit safety data sheets together with the tender. The contractor must submit the documents in the original or a certified copy in electronic form with a qualified electronic signature. If the original of the document referred to above has not been drawn up in the form of an electronic document, the contractor may make and provide an electronic copy of the document in its possession. If the contractor submits an electronic copy of the document, signing it with a qualified electronic signature is tantamount to certifying that the electronic copy of the document is in conformity with the original. Documents drawn up in a foreign language must be submitted together with a translation into Polish. c. If the Contractor fails to submit the above evidence or it is incomplete, the Contracting Authority, in accordance with Art. 2 of the Public Procurement Act, will call the Contractor once within the prescribed time limit to submit or supplement them.
