The detailed scope of works is included in the Detailed Technical Specifications for the execution and acceptance of works and in the bill of quantities of works, which is an auxiliary part of determining the number of works. 4. The bill of quantities is ancillary. Before submitting a tender, the Contractor is obliged to carefully check the number of works with all the documentation available on the website (Public Procurement Platform ZDW in Lublin). 5. Since a works contract is a flat-rate contract, if there is more work under any heading during the course of the works, this cannot be regarded as additional work with a claim for additional remuneration. The possible absence in the bill of quantities of works necessary to perform on the basis of the project documentation does not release the contractor from the obligation to perform them on the basis of the project at the contractual price. 6. The Contractor shall be obliged to: a. preparation and approval of a safety and health plan, b. ensuring safe road and pedestrian traffic conditions in the area of the works covered by the contract on the basis of a traffic organization project (for the duration of the works) approved by the Manager of traffic on voivodeship roads, handed over by the Ordering Party. c. maintaining clean public roads on which the movement of vehicles of construction and transporting materials will take place, making an inventory and reviewing the zero condition of roads intended for transport and determining with the appropriate managers how to use the agreed roads. In the event of any claims for damages by property owners, the Contractor is obliged to repair them at his own expense, which will not be subject to separate payment and is included in the contract price. e. maintaining the road section in question until the final acceptance date. f. ensuring that the works covered by the Contract are managed, for as long as necessary, by persons who are qualified and meet the requirements set out in the Construction Law. Failure by the Contractor to provide personnel to manage the works gives the Supervisory Inspector or the Contracting Authority the right to suspend the works in whole or in part. Any interruption in the execution of the works resulting from the lack of staff to manage the works will be treated as an interruption occurring for reasons attributable to the Contractor and cannot constitute a basis for changing the time to complete the works. 7. In the period from the protocol takeover of the construction site from the Ordering Party, the Contractor shall be fully liable to third parties under general rules for any damage caused to these persons arising on this site, including the use of unregistered motor vehicles. 8. The contractor will carry out the works in accordance with the current regulations in the field of construction law, environmental protection, description of the subject of the contract and in a way that guarantees due diligence. 9. The Contractor shall provide a warranty for the performed subject of the contract for a period consistent with the submitted offer. 10. The subject of the contract is described in the manner specified in Art. 1 point 2 and paragraph. 3 of the PPL Act. The contracting authority shall allow equivalent solutions to be described provided that the contractor proves in the tender, in particular by the means of proof referred to in Articles 104 to 107, that the proposed solutions satisfy to an equivalent extent the requirements set out in the description of the subject-matter of the contract. 11. The contracting authority does not allow partial tenders to be submitted. 12. For the selected variant of contract performance, its division into lots is not justified. Splitting the contract into lots could introduce a relatively short section of several Contractors on the construction site. 13.The Contractor is bound by the offer until 02.07.2025, the deadline for the performance of the contract – 3 months from the date of signing the contract. 14.The Contractor submits an offer via the Platform by 04.04.2025 at the latest.10:00 15.The opening of the offers will take place on 04.04.2025.
