Description
1.The subject of this contract is the purchase and implementation of two matrices and four file heads dedicated to the VNA system (archiving system for imaging tests) for the Maria Skłodowska-Curie National Oncology Institute – National Research Institute, Branch in Gliwice 2. The description of the subject of the contract and the conditions for the performance of the contract are contained in the annexes: 1) Technical specifications of the contract – Annex 2.1 to the FTZ, 2) Product and price specifications – Annex 2.2 to the FTZ, 3) Draft provisions of the contract to be inserted into the content of the contract – Annex 4 to the FTZ. 3. Tenders not containing the full scope of the subject of the contract will be rejected. 4. The contracting authority allows for the possibility of submitting equivalent tenders - the description of equivalence is contained in Chapter IV of the FTZ. 5. The contracting authority does not provide for electronic auctions or supplementary contracts. 6. Information on the contractors’ joint procurement is included in Chapter IX of the FTZ. 7. The Ordering Party provides for the possibility of changes to the provisions of the concluded contract (the so-called contractual changes based on Art. 1 point 1 of the Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions contained in Annex 4 to the FTZ. The agreement may also be amended in the cases referred to in Art. 1 pts. 2-4 and sec. 2 of the PPL Act. 8. The information clause resulting from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, was included by the Contracting Authority in the FTZ. 9. Before concluding a public contract, the contractor whose tender is selected (deemed to be the most advantageous) must lodge a performance guarantee of 5% of the total price indicated in the tender. 10. The contracting authority informs that the contract must comply with the DNSH Principle (‘do no serious harm’; ENG ‘Do No Significant Harm’), which is the principle of not supporting or conducting economic activities that cause significant damage (serious damage, has a significant negative impact) to any of the environmental objectives such as 1) climate change mitigation 2) climate change adaptation, 3) sustainable use and protection of water and marine resources, 4) circular economy, 5) pollution prevention and control, 6) protection and restoration of biodiversity and ecosystems 11.The procurer plans to finance the subject of the contract under the Recovery and Resilience Facility for projects under investment D1.1.2 ‘Accelerating the digital transformation of health through the further development of digital health services’, which is part of component D ‘Efficiency, accessibility and quality of the health system’. 12. Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority provides for the possibility of cancelling the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not granted to it. 13.
