Description

1. The subject of the contract is the supply of replacement fluids, dialysis fluids, for perfusion and storage of organs and rinsing fluids used in ophthalmology for UCK in the assortment, the estimated quantity and the requirements set out in Annex 3 to the SWZ. 2. The contracting authority shall allow partial tenders to be submitted. Partial tenders are understood as individual items set out in Annex 3 to the ToR. The Contractor may submit a tender for one or more items. 3. Deliveries will be made successively, in quantity and assortment, in accordance with partial orders of the Ordering Party within 2 days from the date of placing the order. The Contractor will be obliged to deliver the ordered assortment at his own expense to the Hospital Pharmacy. 4. The offered medical devices must comply with the Act of 20 May 2010 on medical devices (Journal of Laws No. Journal of Laws 2021, item 1565) and in implementing acts issued on the basis of that paragraph, if applicable. 5. The contracting authority shall allow an equivalent tender to be submitted in respect of items 1, 2, 3, 4. The Ordering Party informs that any proper names used in the description of the subject of the contract specify the required standard of the ordered assortment. The Contracting Authority allows the submission of tenders with equivalent quality parameters, having the same chemical composition in terms of basic substances. Proof of compliance with the equivalence condition shall lie with the Contractor. 6. If the Contracting Authority used in the description of the subject of the contract the markings of standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3 of the PPL Act, equivalent solutions are allowed. Whenever a standard is referred to in this RTS or its annexes, the wording ‘or equivalent’ shall be presumed to have been used in relation to it. Where the description of the subject-matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in para. 1 point 2 and sec. 3, the contracting authority may not reject a tender on the sole ground that the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract refers, provided that the economic operator proves in the tender, in particular by the means of proof referred to in Articles 104 to 107, that the solutions proposed satisfy to an equivalent extent the requirements set out in the description of the subject-matter of the contract. 7. The contracting authority requires the submission of tenders in electronic form. A detailed description (instruction) of the submission of tenders in electronic form is contained in paragraph XIV of the SWZ. The Contracting Authority informs that in the public procurement procedure in question, the so-called "Public Procurement Procedure" will be used. the ‘reverse order of tender evaluation’ referred to in Article 139 of the Public Procurement Act. Using the above procedure, the contracting authority will first examine and evaluate the tenders, and then make a qualitative selection of the contractor whose tender was the highest scored in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. 14.
