(22) Successive collection, transport and management of waste classified under waste code 19 12 12 – other waste (including mixed substances and objects) from mechanical treatment of waste other than those mentioned in 19 12 11
1. The subject of the contract is - under the conditions described in the contract to be concluded between the Ordering Party and the Contractor, SWZ and in the Contractor's offer - the successive collection, transport and management of wastes classified under code 19 12 12 collected by the Contractor from the Ordering Party - other wastes (including mixed substances and objects) from mechanical treatment of wastes other than those mentioned in 19 12 11 divided into 3 parts, in the types and quantities specified below. 2. Waste may only be subjected to R1 and/or R12 recovery operations, as specified in the Waste Act of 14 December 2012. (Journal of Laws 2023.1587, as amended)/Annex IA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste (OJ U. EU. L 190/1, as amended), whereby ‘subject to a recovery operation’ means the commencement and completion of that operation. 3. The subject of the Order includes: part No 1 – being a fraction of ballast waste with an energy value from the municipal waste sorting process in the amount of 8900 Mg (+/-) 10 Mg (quantitative differences may result from storage conditions and from the applied technical and technological solutions of the weighing system), but not less than 900 Mg (minimum provision) Bulk waste. (e) Part No 2 – being a fraction of ballast waste with an energy value from the municipal waste sorting process in the amount of 8900 Mg (+/-) 10 Mg (quantitative differences may result from storage conditions and from the applied technical and technological solutions of the weighing system), but not less than 900 Mg (minimum provision) Bulk waste. (f) part 3 – being a fraction of ballast waste with an energy value from the municipal waste sorting process in the amount of 8900 Mg (+/-) 10 Mg (quantitative differences may result from storage conditions and from the applied technical and technological solutions of the weighing system), but not less than 900 Mg (minimum provision) Waste in bulk. 4. The contractor must indicate in the tender form (Annex 1 to the FTZ) the recovery operation to which the waste will be subjected. 5. Collection of waste: 1) The transfer and collection of Waste will take place only on the basis of and in accordance with the written [form on pain of nullity] individual orders of the Ordering Party addressed to the Contractor and delivered by e-mail, specifying the amount of Waste and the date on which the Ordering Party expects their collection. 2) The Ordering Party will place unit orders when the collected amount of Waste to be collected in one day will be a minimum of 16 Mg, 3) the Contractor will collect Waste while maintaining the following technical infrastructure requirements at the Ordering Party's plant: a) the gross weight of an individual vehicle entering the premises (empty vehicle for loading) must not exceed 18 tonnes b) the distance between the extreme axles of an individual vehicle must not exceed 16 metres and the length of the vehicle must not exceed 18 m c) the loading of bulk waste is carried out ‘from above’ 4) After weighing the vehicle loaded with waste, the Ordering Party will issue a delivery document from the warehouse. 5) The Ordering Party shall draw up a Waste Transfer Card [KPO] for each batch of Waste collected from its plant by the Contractor's transport. These cards will be issued in accordance with the Waste Act. The Contractor shall be responsible for confirming by the Operator of the Installation in which the recovery process will be carried out, the weight and type of Waste specified in each Waste Transfer Card issued by the Ordering Party, in accordance with the Waste Act. 6) If the shipment of waste is international, the documents specified in Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste (Journal of Laws of 2006, No. U. EU. L 190/1 as amended). Documents will be drawn up in accordance with the requirements of the above-mentioned Regulation.
