Procurement of ‘Laboratory apparatus: laboratory multimeter and UV-VIS spectrophotometer for the Faculty of Medicine and Pharmacy – Department of Pharmaceutical Sciences’, in accordance with the specifications.
Number of days until which clarifications may be requested before the closing date for submission of tenders/applications: 15 days.
The contracting authority shall reply clearly and completely to all requests for clarification: 10 days before the deadline set in the contract notice for the submission of tenders.
Any request for clarifications must be sent to SEAP (http://sicap-prod.e-licitatie.ro/pub).
The award procedure is initiated under this suspension clause, in that the conclusion of the public procurement contract is conditional upon the conclusion of the financing contract with the MEC, the signature of the contract being carried out in compliance with the provisions of Decision No 395/2016 approving the implementing rules for the provisions on the award of the public procurement contract/framework agreement in Law No 98/2016 on public procurement.
Taking into account the provisions of Decision No 395/2016 and Law No 98/2016, the contracting authority states that it will conclude the contract with the bidder declared to be successful only to the extent that the funds necessary for the procurement will be secured by signing the financing contract with the MEC.
If, for whatever reason, the financing contract with MEC is not signed, the contracting authority reserves the right to apply Article 212 (1) (c) of Law No 98/2016 on public procurement, after receiving notification from MEC of the non-award of funding, since it is impossible to conclude the public procurement contract.
Tenderers in this procedure understand that the contracting authority and/or MEC cannot be considered to be liable for any damage in the event of the cancellation of the award procedure, regardless of its nature and regardless of whether the contracting authority and/or the MEC have been notified of the existence of such damage.
The bidders in this procedure accept the use of the above special conditions/suspension clause, answering them to any damage they might suffer in the situation described.
