1. The subject of the contract is the design and construction of technical infrastructure in the Strategic Investment Park in Stalowa Wola. 2. The whole task is divided into the basic task (guaranteed) and part of the task covered by the law of option (8 parts), while the Contracting Authority stipulates that contractors should price all the components of the task (i.e. the basic task and 8 parts covered by the law of option) as part of the tender. Failure to evaluate any of the nine components of the task (basic contract and 8 parts covered by the right of option) and not to include it in the tender will result in the rejection of the tender pursuant to Art. 1 point 5 of the Public Procurement Act as an offer that does not comply with the terms of the contract. 3. A detailed division of the contract, including the scope of the basic task and tasks covered by the option right, is described in Annex 1 to the SWZ – Description of the subject of the contract. 4. In addition, the detailed scope of the contract was defined in the Functional and Utility Program and other annexes constituting annexes to the SWZ. 5. This list shall be used in the event of a change of person(s) carrying out the activities referred to in point (a). 1) should be updated immediately each time. 3) In the event of entrustment by the contractor of the part of the contract covering the performance of the activities referred to in point. 1) for the subcontractor, the obligation to employ persons performing these activities under an employment contract will also apply to the subcontractor. 4) During the performance of the contract, the contractor (subcontractor) at the request of the contracting authority should provide evidence confirming the employment of the persons referred to in point. 8 (1) to (3). 5) In the event of non-compliance by the contractor (subcontractor) with the obligations referred to in point. 8 points 1-3, the contracting authority shall provide for sanctions in accordance with the model contract annexed to the CVT. 6) The above requirement does not apply to the construction/works manager because, in accordance with Article 12 of the Construction Law, the activity involving the management of the construction or other construction works may be performed by a person performing an independent technical function in the construction industry.
