Description

The purpose of this framework contract is to guarantee the following:
— all individual or collective new building operations,
— acquisition and improvement operations,
— rehabilitation works.
And in respect of damage to the works and liability of CNR, construction operations carried out on behalf of third parties:
— in the context of contracting authority tasks,
— project management assistance,
— from ownership or sale.
This includes, without exception or reservation, all works carried out by Habitation Moderne, whatever their purpose (accommodation, homes, car parks, offices, shops, EPHAD, crèches, etc.).
The concept of major repairs and improvement works is understood broadly, including heavy rehabilitation operations, restructuring and improved acquisition operations, and in general any intervention by Habitation Moderne which is likely to be subject to the provisions of the Insurance Code.
Moderne shall act, both on its own account when acting as the contracting authority, and on behalf of third parties where it is acting in the context of tasks of contracting authority or assistance to project management for the benefit of other persons, whether natural or legal, governed by public or private law.
The purpose of the contract is to enable Habitation Moderne, acting as contracting authority or agent of the contracting authority, to comply, in particular, with the insurance obligation resulting from the provisions of the Insurance Code, and the subsequent texts, in respect of all construction operations for which the date of opening of the site is between 1.1.2012 and 31.12.2015.
In all cases, Habitation Moderne remains free to choose the guarantees it intends to subscribe to depending on the nature and consistency of the construction operations to be guaranteed.
The guarantee covering the risks of manufacturer who is not a director shall be taken out only when the Moderne delegation is acting in the context of tasks relating to the contracting authority, assistance to the contracting authority, or as a seller or developer, it being specified that the relevant premium base will be limited only to those parts of buildings which are the subject of a contract of sale or a contracting authority.
