Description

The Capital Region of Denmark intends to amend the ambulance contract Lot 5, due to the Supreme Court ruling, so Falck operates one round-the-clock ambulance as an effective emergency response. The Capital Region of Denmark considers that the change can be made within Section 183 of the Public Procurement Act. The modification is not considered to be a modification of fundamental elements as (1) the need for the modification could not be foreseen by a diligent contracting entity, (2) the overall nature of the contract is not altered and (3) the value of the modification does not exceed 50 % of the value of the initial contract. It has been assumed, among other things, that legislative amendments must clearly be regarded as ‘external’ matters, the conversion of one ambulance service does not constitute a change in the overall nature of the contract, and the value of the amendment does not exceed 50 % of the value of the original contract.
