Open procedure above Community threshold, divided into two lots, for the award of a contract for the disinfestation service at the RAI settlements in Rome, Naples, Milan and Turin
With regard to each lot, the contract covers the ‘fee-based’ and ‘on-demand’ disinfestation service by rodentisation, deblactisation, dezanzarisation (larvicide/adulticida), removal of rat/mouse carcasses, removal of animal carcasses, guano removal, removal of hornet wasp nests and bees, creeping insect disinfestation, processional pine disinfestation, disinfestation of flying insects, sanitary disinfection in order to eliminate insects or other groups of animals that may cause damage to infrastructure, food losses or cause disease. Pursuant to Article 58 of the Code, the procedure is divided into the following two lots, the scope of which has been defined on the basis of separate qualitative, functional and quantitative criteria detailed below: Lot 1 - Disinfestation service for the needs of the offices of Roma DG, Roma Nord, Roma Centro and Napoli Centro di Produzione TV; Lot 2 - Disinfestation service for the needs of the offices of Turin DG, Turin TV Production Centre and Milan TV Production Centre. On the basis of the relevant principles, the scope of the lots has been defined taking into account the characteristics of the needs and the need to facilitate access to the market for micro, small and medium-sized enterprises, while ensuring the effective performance of the services, on the basis of the following criteria: (i) territorial continuity and geographical proximity of the sites, in order to allow a more efficient organization of planned interventions and any emergency activities; (ii) rationalisation of logistical costs and intervention times to ensure a stable operational presence in the territories concerned; (iii) economic dimensioning of the lots compatible with the organizational and operational capacity of micro, small and medium-sized enterprises, avoiding the aggregation of the entire needs in a single entrustment of significant economic entity. In that context, in order to avoid, on the one hand, the risk of concentration of several lots in a single economic operator, thus also mitigating the risk at enforcement level that any failure to fulfil obligations on one lot will have repercussions on the other and to encourage the participation and access of MSMEs, pursuant to Article 58(4) of the Code, a limit is laid down on the number of lots that may be awarded by the same tenderer. In particular, each tenderer – although it may submit a tender for all the lots in which the invitation to tender is divided – will be able to win only one lot and the relevant award will take place in descending order of the economic amount of the lots, starting from the highest value (Lot No 1). Should it not be possible to award one of the two lots due to the lack of valid tenders, the Contracting Authority reserves the right to award any remaining lot, even by way of derogation from the limit indicated above, if a valid tender is submitted by the resulting competitor already awarded the other lot, provided that it meets the requirements also for the remaining lot.
