1. The subject of negotiations will be the conditions for the implementation of the contract described below and the price for the collection and management of 1 Mg of waste with code ex19 12 12. 2. The contracting authority, in an open tender for the collection and management of the above-mentioned waste (reference No ZGOK/PN/13/2023), provided for the possibility of awarding the contracts referred to in Article 214(1) of the GATT 1994. 1 point 7 of the Public Procurement Act to the value of: PLN 20 000 000.00 net, which amounted to EUR 4 490 749.06 (at the date of estimating the value of the contract at the euro exchange rate of 4.4536. The waste subject to the contract is partially stabilised in the aerobic process of biodrying the waste, due to the short process time (7-14 days). Dried waste is sorted into fractions, resulting in the above-mentioned fraction 0-60 mm. The waste contains a variable amount of organic fraction, which should be further processed in accordance with the requirements of the Regulation of the Minister of Climate and the Environment of 28 December 2022 on the mechanical-biological treatment of unsegregated (mixed) municipal waste (Journal of Laws No. Journal of Laws 2023, item 56). 4. The development processes approved by the Ordering Party are: D8 or R3. In addition, the Contracting Authority allows waste to be subjected to the R12 process, with the proviso that the final development will take place in the D8 or R3 processes in another installation indicated by the Contractor. 5. The amount of waste with code ex19 12 12 resulting from the mechanical treatment of municipal waste intended for collection and management under the contract will be determined after the unit price for the collection and management of the above-mentioned waste has been negotiated. 6. The contracting authority has no influence on the size of the incoming waste stream, due to the high variability of this stream, therefore it intends to divide the volume of waste for reception and management under this contract into the basis and option referred to in Art. 1 of the Public Procurement Act, consisting in increasing the amount of waste with code ex19 12 12 intended for collection and management 7. Waste will be offered in the form of: in bulk.
