Supply, delivery and marking of promotional items for the Provence-Alpes-Côte d'Azur Region
This is a multi-awardee framework agreement within the meaning of Articles R. 2162-2 et seq. of the Public Procurement Code concluded with 3 economic operators (subject to a sufficient number of compliant tenders). The framework agreement will be implemented in part through the conclusion of subsequent contracts and in part through the issuance of purchase orders awarded by the cascade rule in accordance with Article R2162-3 of the Public Order Code. It is concluded without a minimum and with a maximum amount stipulated in each act of commitment Each lot takes the form of a framework agreement concluded with three economic operators. Each framework agreement will be implemented in part: -A order forms setting out all the contractual stipulations in accordance with Articles R2162-13 and 14 of the Public Order Code (executed by means of order forms) and at unit prices present on the unit price schedule or on the catalogue(s)/database(s) with public tariffs, order platform. - In subsequent contracts, where the framework agreement does not lay down all the contractual stipulations, it will give rise to the conclusion of subsequent contracts under the conditions laid down in Articles R. 2162-7 to R. 2162-12 of the Public Order Code. The party to subsequent contracts will be used incidentally, when the needs of the Region are not satisfied by the unit price schedule and/or the holder's catalogue(s), provided that it falls within the scope of the subject of the framework agreement. These include specific products that are difficult to predict or cannot be identified in advance. This contract allows the use of the supplies or services listed in the contractor’s catalogue(s). It is expressly stated that the use of this catalogue is subject to a ceiling of 30% in relation to the maximum amount specified in the acts of commitment for each lot. The terms and conditions for awarding subsequent contracts and issuing purchase orders are set out in the CAPC.
