SUBJECT OF THE PUBLIC ORDER: Engineering (design, supervision and construction and installation works) for a site: ‘Rehabilitation and reconstruction with replacement of a water main on Petko Karavelov Street in the section from Alexander Stamboliyski Street to Vasil Levski Street, Harmanli’ SHORT DESCRIPTION OF THE ACTIVITY IN THE SCOPE OF THE ORDER: 1. DESIGN 2. CONSTRUCTION – INSTALLATION WORKS (INSTRUCTION WORKS) 3. A technical specification has been prepared and bidders should prepare their bids in accordance with it. 5. DEADLINE OF CONTRACT IMPLEMENTATION: The contracting authority shall determine a maximum permissible period for the execution of the contract of up to 180 calendar days, of which up to 30 calendar days for the preparation of an investment project in the technical phase and up to 150 calendar days for the execution of the construction and installation works. The deadlines for implementation of the activities are at the proposal of the participant. The deadlines proposed by the participants should not be beyond the maximum deadlines specified by the Contracting Authority. In the event of a discrepancy in any of the deadlines specified by the Assignor, the tender of the participant will be removed from further participation in the procedure. 5.1. The deadline for the elaboration of an investment project in the technical phase begins to run from the date of receipt of a commission letter for the start of the activity of drawing up a technical project by the CONTRACTING AUTHORITY and is until the draft prepared by the CONTRACTOR is submitted to the CONTRACTING AUTHORITY with a protocol of acceptance and delivery. The deadline for the preparation of the project does not include the time for coordination of the prepared project with the competent authorities/persons and operating companies, as well as any other coordination deadlines. 5.2. The deadline for the implementation of the construction works starts from the date of signature of a Protocol for the opening of a construction site and the determination of the construction line and level (Annex 2 to Article 7(3)(2) of Regulation No 3/31.07.2003 on the drawing up of acts and protocols during construction) until the signing of a statement of findings establishing the suitability for acceptance of the construction (Annex No 15, in accordance with Regulation No 3/31.07.2001 on the drawing up of acts and protocols). 5.3. Period for exercising author's supervision - from the signing of a Protocol for the opening of a construction site and determining the construction line and level (Annex No 2 to Article 7(3)(2) of Ordinance No 3/31.07.2003 on the drawing up of acts and protocols during construction) to the signing of a statement of findings establishing the suitability for acceptance of the construction (Annex No 15, pursuant to Ordinance No 3/31.07.2001. The proposed deadlines should be in whole numbers. FORECAST ORDER VALUE: BGN 628 533.34 excluding VAT, of which: -the maximum financial resource for the implementation of rehabilitation and reconstruction of a street is BGN 384,000.00 excluding VAT; -the maximum financial resource for replacement and construction works of plumbing is BGN 228 700.00 excluding VAT; -the maximum financial resource for design is BGN 12 500.00 excluding VAT; -the maximum financial resource for exercising author's supervision is BGN 3 333.34 excluding VAT. IMPORTANT: The participants must prepare their proposals in compliance with the maximum value of the budget determined by the CONTRACTING AUTHORITY as a whole and respectively by the different types of activities. These estimates are final for the CONTRACTING AUTHORITY. If a higher price is proposed for the relevant activity, the participant will be excluded from the procedure on the basis of Article 107(2)(a) of the Public Procurement Act on grounds of non-compliance with this pre-announced condition. All payments under the public procurement contract will be made by bank transfer in BGN. Payment of the price for the execution of the public procurement shall be made on the basis of the price proposal proposed by the Contractor. Source of funding IMPORTANT!!! At the time of the opening of the procedure, no funding was provided for the activities covered by the contract. In this regard, and in accordance with Article 114 of the PPA, the implementation of this public procurement contract will be considered to have been awarded under the suspensive condition of providing targeted funding. In the event that such financing is not provided, the contract concluded between the Contracting Authority and the Contractor may not be performed. In such a case, either party may terminate the contract unilaterally without notice at the end of three months from the conclusion of the contract and the parties shall not be liable to each other for damages.’ For this reason, performance begins after confirmation by the contracting authority of secured funding and presentation by the contractor of the performance guarantee. In the event of failure to provide the performance guarantee within the period specified by the contracting authority, without objective reasons, the contracting authority shall terminate the contract. Either contracting party may request the termination of the contract without notice at the end of a period of three months from the conclusion of the contract. Where, after a period of 10 months from the conclusion of the contract, no financing is provided, the contract shall be deemed terminated. PLACE OF CONTRACT IMPLEMENTATION: on the territory of the Municipality of Harmanli on P. Karavelov Street in the section from Alexander Stamboliyski Street to Vasil Levski Street.
