Description

The contracting authority shall conclude a framework agreement, with a single economic operator, for each individual lot, covering the supply of food products. The subject-matter and purpose of the framework agreement is to determine the essential elements/conditions that will govern the subsequent contracts to be awarded under and for the duration of the framework agreement. The purchase of food products is necessary for the feeding of persons deprived of liberty and is based on Order No 3.147/C of 8 August 2018 approving the Rules for granting food rights to persons deprived of liberty in the prison administration system, as subsequently amended and supplemented. The contracting authority foresees the purchase of the products in the minimum and maximum quantities, following the award of the follow-up contracts to the framework agreement according to the needs and the budgetary funds allocated. The quantities requested are estimated minimum and maximum quantities and can be found in the document ‘ANNEX – FOOD REQUIREMENT’ registered under No 52340/30.09.2025. The contracting authority wishes the framework agreements to be concluded for a period of 12 months. Through the subsequent contracts to be concluded between the parties, the minimum quantities may not be reached, the maximum quantities may be exceeded with the value of supplementing the framework agreement within the limit of 10%, without circumventing the provisions of Law No 98/2016, as subsequently amended and supplemented, which establishes obligations of the contracting authority in relation to certain value thresholds. The estimated minimum and maximum quantities of the framework agreements and their subsequent contracts, as well as the estimated value of the largest subsequent contract, can be found in the document ‘ANNEX – REQUIREMENTS FOR FOOD PRODUCTS’ registered under No 52340/30.09.2025. Contracts subsequent to framework agreements will be concluded monthly or quarterly whenever necessary, depending on the needs of the contracting authority. The number of days in which clarifications can be requested before the deadline for submission of tenders is 20 days. The contracting authority will respond clearly and completely to all requests for clarifications/additional information 11 days before the deadline set in the contract notice for the submission of tenders, given that, according to Article 161 of Law No 98/2016, as subsequently amended and supplemented, economic operators must have at least 10 days to prepare their tender in accordance with the additional requirements introduced by the reply to the clarifications/additional information.
