1. The subject of the contract is the supply of a brand new school bus, a year of production not older than 2025, approved and compliant with the applicable regulations and technical conditions for school buses, intended for transport to schools of children and young people, including children with disabilities in a wheelchair from the municipality of Brzeźnio. By ‘supply of a school bus’, the Contracting Authority means the supply of a category M3 bus (e.g. an intercity bus), which will be adapted to transport children and young people, including meeting the requirements for school buses set out in the provisions of generally applicable law, in particular Section 22 of the Regulation on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws 2024, item 502 t.j.). 2. The description of the minimum technical requirements, equipment and documentation for the school bus is set out in the Detailed Description of the subject-matter of the contract (OPZ), which is Annex 1 to the FTZ, and the method of performance of the subject-matter of the contract is set out in the Specification of the Conditions of the contractand in Annex 6 to the FTZ. 3. The school bus offered should be allowed to be marketed on the territory of Poland and adapted to the public sub-routes of the territory of Poland, in particular it should meet the requirements set out in the regulations, in particular: 3.1. Act of 20 June 1997 on the right-hand traffic (Journal of Laws of 2024, item 1251zezm.), 3.2. Regulation of the Minister for Infrastructure of 31 December 2002 on the technical conditions of vehicles and the range of necessary equipment (Journal of Laws 2024, item 502 as amended); 3.3. Regulation of the Minister for Infrastructure of 8 November 2024 on the registration and marking of vehicles,requirements for registration plates and models of other documents related to vehicle registration (Journal of Laws No. U. item 1709, as amended); 3.4. Act of December 21, 2000 on waterborne engineering (Journal of Laws of 2024, item 1194). 3.5. At the latest on the day of receipt of the subject of the contract, the Contractor shall provide the Contracting Authority with the bus approval certificate and the decision of the Office of Technical Inspection authorising the operation of the liftfor persons with disabilities intended for the transport of people in wheelchairs, regarding the copy installed in the delivered bus. 4. The contracting authority informs that the term ‘school bus’ should be understood as a bus of category M3, class II (intercity bus), which meets the requirements of the Regulation of the Minister for Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws 2002, No. Journal of Laws 2024, item 502, as amended), in particular in §22 [School bus]. The subject of the contract is intended for use by natural persons, so in accordance with Art. 1 of the Act of 11 September 2019. Public procurement law (Journal of Laws 2024, item 1320 as amended), the Ordering Party requires that the bus be adapted for use by all users, taking into account accessibility requirements for persons with disabilities. 5. The contract is co-financed from the budget of the Łódzkie Region as part of the ‘Buses for schools from Łódzkie’ project. The delivered bus should be marked by displaying the logotype of the Lodz Voivodeship. The marking shall be affixed in accordance with the model marking annexed to the description of the subject-matter of the contract, in such a way as to ensure that the logos are clearly visible and recognisable, without distortion, and of a size proportionate to the size of the bus purchased. 6. The contracting authority shall require a minimum of 36 months' mechanical warranty for the entire subject-matter of the contract, including the coating of the paintwork and electrical and electronic components, mechanisms including the chassis, including the lift for persons with disabilities intended for the carriage of persons in wheelchairs (hereinafter referred to as "the lift"), as well as all bus components, regardless of whether they have been manufactured by the Contractor or by third parties, for a period of not less than 36 months. The final quality guarantee period for the entire bus will result from the tenders of the selected Contractor, the length of the guarantee period being one of the criteria for the evaluation of tenders in accordance with Chapter XVIII of the FTZ. The starting date of the quality guarantee period shall be the date on which the final protocol of the subject-matter of the contract is signed without reservation. The Contractor shall be fully liable for any defects discovered during the warranty period, irrespective of any warranties provided by component manufacturers. Granting a quality guarantee does not exclude or limit the Contractor's liability under the warranty for defects in the subject of the contract resulting from the provisions of the Civil Code. 7.It is recommended to read the content of the Terms and Conditions of the Order in detail, to obtain all information necessary for the proper preparation of the offer and to immediately inform the Ordering Party of any errors and omissions 8.MaincodeCPV:34121000-1Busys and coaches 9. Contractors shall perform and bear the costs associated with the performance of the subject of the , contract by delivering the bus to the place of delivery: Brzeźnio, ul. It's 44 in common. 10. The Ordering Party does not reserve the obligation for the Contractor to personally perform key tasks related to the subject of the contract. The contractor may subcontract the performance of elements (parts) of the subject-matter of the contract. If the contractor intends to perform the subject-matter of the contract with the participation of subcontractors, the contractor is required to indicatetheirpart(s) of the contract(s) which they intend to performto subcontractors,and any subcontractors, if they are already known. This must be indicated on the offer. If subcontracting is not indicated in the Tender, the Contractor will be able to introduce a subcontractor only under the conditions set out in the contract. 11. The Contractor undertakes to perform the subject of the contract correctly, in accordance with the requirements
