Introduction This notice is used only to make the intended choice of procedure known in advance to the market in order to give interested parties the opportunity to raise any objections. Client Client for the agreement is Waterschap Drents Overijsselse Delta, hereinafter referred to as: Client. The subject of the public contract concerns framework agreements for mowing maintenance in rural areas and a framework agreement for mowing maintenance in Keringen. Explanation of the chosen procedure This notice is only used to make the intended choice of procedure known in advance to the market in order to give interested parties the opportunity to raise any objections. If, despite the attached statement of reasons, interested parties wish to object to the above-mentioned intention, they must submit a reasoned objection to the continuation of this procedure within 20 calendar days of the publication of this notice. The period of 20 calendar days is a limitation period on pain of inadmissibility. If no objection has been raised during this period, the rights of undertakings to challenge the proposed procedure will lapse. WDODelta uses framework agreements for part of its mowing maintenance. The implementation of these agreements is based on the ‘Code of Conduct Nature Protection Act for water boards, part of species protection’ as an important framework. The current Code of Conduct was extended by the Netherlands Enterprise Agency (RVO) on 2 June 2023 until 1 January 2025. There is currently no approval by RVO and LVVN for a new Code of Conduct. As a result, it is unclear what the exact consequences will be with regard to the mowing maintenance to be carried out. The new expected effective date of the amended Code of Conduct is scheduled for 1 April 2025, but because there is still no approval by RVO and LVVN, and an internet consultation has yet to be completed, it is uncertain that this set date will be met. Due to these uncertainties about the content and the final date of entry into force, it is currently not possible for WDODelta to bring a clear request to the market for its new framework agreements for mowing maintenance. WDODelta has therefore decided to conclude a bridging agreement with the current contractors of the framework contracts for mowing maintenance. Due to the 2 mowing rounds in May and September, the bridging agreements have been chosen to run until 31 December 2025, so that there is no need to switch between the mowing rounds between contractors. The decision to conclude framework contracts for mowing maintenance with the current contractors was taken on the basis of Article 2.32(1)(c) of the Aw 2012. The absence of a adopted new Code of Conduct is an event that could not have been foreseen by WDODelta and cannot be attributed to WDODelta. As soon as the new Code of Conduct has been adopted, WDODelta will start a tender procedure for mowing maintenance for 2026 as soon as possible.
