. The subject of the contract is the supply of cytostatic drugs 2. A detailed description of the subject of the contract is attached as Annex 2 to the SWZ. 3. The Contractor is obliged to perform the contract on the terms and conditions described in the model contract constituting Annex 5 to the SWZ. 4. CPV Common Procurement Vocabulary: 33600000 – 6 – Pharmaceuticals, 33140000-3 – Medical supplies 5. The contracting authority accepts the possibility of submitting partial tenders. (a) The subject of the contract has been divided and described in 18 parts. (b) Each part of the contract will be referred to hereinafter as a ‘PACKAGE’, which has been marked in the documentation as Package No 1 to 18. (c) Each package is a separate subject of the contract. (d) The scope and size of each package is presented in detail in the assortment and price forms , marked and described in the SWZ as Annex 2 , in which the required assortment is given in detail. (e) The contracting authority accepts the submission of tenders for one, more parts as well as for the whole contract. (f) The contracting authority accepts the possibility of submitting equivalent tenders (the equivalent tender should contain medicines with the same composition and operation). (g) The quantities indicated in Annex 2 constitute estimated annual consumption and may be reduced to 20% of the unused quantity, without constituting the contracting authority's obligation to fully implement it. or the basis for claiming damages by the Contractor for failure to use the maximum value of the contract. h) The Ordering Party may change the quantities of individual assortment within the limits of the amount of a given package. i) The deadline for the implementation of the current order of medicines – 24 hours, delivery in the ‘CITO’ mode (delivery to save lives) within 12 hours from the moment of placing the order. j) The deadline for the implementation of the current order of medical devices is up to 48 hours. k) Deliveries will take place to the Hospital Pharmacy from 8:00-14:00 or to a given Hospital Branch after consultation with the Pharmacy when placing the order. l) It is allowed to price equivalent or bioequivalent medicines, while maintaining the same route of administration, form and dose (power) e.g. tablets instead of: dragees, capsules, film-coated tablets and vice versa, and ampoules instead of vials, pre-filled syringes and vice versa. ⁇ If a drug has been withdrawn from the manufacturer's offer, the manufacturer has ceased its production, or the registration of the drug has expired, the Ordering Party informs that the drug should not be valued from this item and attach to the offer a statement of the manufacturer about the cessation of production of the drug. If there is a temporary shortage of the medicine, state its last applicable price and indicate that it is a temporary shortage of production . If possible, offer an equivalent of this medicine. 6. The offered cytostatic drugs must comply with the Catalogue of drugs reimbursed in chemotherapy and drug programs - in accordance with the announcement of the Minister of Health issued on the basis of Art. 1 of the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws No. Journal of Laws No 122, item 696 as amended) 7. The Contracting Authority reserves the right to flexibly select doses to the extent described in Annex 2 to the SWZ 8. The contractor who will supply medicines must ensure deliveries in accordance with the requirements for cytostatics, i.e. with the procedures of Good Distribution Practice specified in the Regulation of the Minister of Health of 26 July 2002 on Good Distribution Practice procedures (Journal of Laws No. 144 item. 1216 of 22 September 2002 and pursuant to Article 79 of the Act of 6 September 2001. The Ordering Party requires that on each VAT invoice with cytotoxic drugs, the Seller enters an EAN code or other code corresponding to the EAN code of a given product 10.
