Description

1. DESCRIPTION OF THE PROCUREMENT OBJECT 1. The subject-matter of the contract is the following: ‘Removal and management in accordance with the Waste Act in the final recovery or disposal of hazardous waste deposited in a warehouse on the property in Dąbrowa Górnicza at 41 Puszkina Street (within plot No 5271 area 0013 Strzemieszyce Wielkie)’. 2. The subject of the contract is implemented on the basis of Article 127 in conjunction with Article 128 of the Act of 17 June 1966 on enforcement proceedings in administration. The commencement of the works in question may take place after the decision on the application of substitute performance has become final, of which the Contracting Authority shall immediately inform the Contractor, and after the signing of the property transfer protocol. 3. As part of the above-mentioned task, the Contractor is obliged to perform the disposal and management service in accordance with the Waste Act in the final recovery or disposal of hazardous waste containers from the aforementioned location. 4. The waste is located in a warehouse, in containers of different capacities - in the estimated amount of: in 137 Mauzer tanks with a capacity of 1000 dm3 (so-called pallet-containers), 274 barrels with a capacity of 200 dm3, 43 barrels with a capacity of 100 dm3, 60 barrels with a capacity of 50 dm3 and 30 barrels with a capacity of 30 dm3; estimated total mass of hazardous waste 260 Mg. Containers with waste are arranged on the concrete floor of the hall (mostly in storeys - three layers), mainly along the northern wall of the hall. 5. Estimated total amount of waste to be disposed of: 260 Mg. 6. According to the Chemical and Toxicological Opinion of March 2018, samples of factual evidence were collected on 5 December 2017. 7 samples were taken from 137 pieces of 1000 liter containers, 3 samples from 274 pieces of 200 liter barrels, 3 samples from 43 pieces of 100 liter barrels, 3 samples from 60 pieces of 50 liter barrels, 3 samples from 30 pieces of 30 liter containers. The contents of containers and barrels are waste containing, inter alia: BTX (sum of benzene, toluene, ethylbenzene and xylenes), mineral oil, PAH (naphthalene, phenanthrene, anthracene, fluoranthene, benzo(a)pyrene, pyrene, b(a)anthracene, chrysene, acenaphthene, b(k)fluoranthene. 7. On the basis of the above-mentioned opinion, waste was classified in accordance with the Regulation of the Minister for Climate of 2 January 2020 on the waste catalogue (Journal of Laws 2020, item 10) as waste with the code: 16 81 01* - wastes exhibiting hazardous properties, resulting from accidents and random events. 8. The amount of waste covered by the contract is an estimate . The settlement of the task will concern the quantities actually received, transported and managed in accordance with the Waste Act in final waste recovery or disposal operations. 9. Other requirements concerning the performance of the subject of the contract are contained in §2, §3 and subsequent draft contracts constituting Annex 6 to the SWZ.
