A detailed description of the scope of the subject-matter of the contract is contained in Annex 1 - Description of the subject-matter of the contract and Annex 4 to the FTZ Designed Provisions of the Agreement. 4. If the Ordering Party used in the description of the subject of the contract trademarks, patents or origin, source or specific process that characterizes the products or services provided by a specific Contractor, referred to in Art. 5 PPL should be understood as exemplary. The Ordering Party, in accordance with Art. 6 PZP, in any case, allows the use of solutions equivalent to those described in the FTZ. Whenever a standard, technical assessment, technical specification and technical reference system referred to in Art. 1 point 2 and paragraph. 3 PPL, it must be assumed that the term ‘or equivalent’ is used in relation to it. By equivalent standards, the Employer means standards the scope of which is analogous to the scope of the standards indicated by name for a given role, i.e. concerning: 1) a similar substantive field resulting from the role to which the standard applies; (2) the corresponding level of safety resulting from the role to which the standard relates; 3) the corresponding level of competence; - confirmed by test results (applies only to those roles for which the fulfilment of standards must be confirmed by test results). If the Ordering Party has used specific certificate names in the FTZ, the description of the subject of the contract or other procurement documents, it is permissible to submit tenders with equivalent certificates, provided that they are expressed in a clear manner and in accordance with the requirements of the Ordering Party. By equivalent certificates, the Ordering Party means certificates that are analogous in scope to the examples of certificates indicated by name for a given role, which is understood as certificates concerning: 1) a similar substantive field resulting from the role covered by the certificate; 2) the corresponding level of competence; (3) the corresponding level of professional experience required to obtain the certificate in question; - confirmed by an exam (applies only to those roles whose exemplary certificates must be confirmed by an exam). By equivalent solution, the Ordering Party means a solution that allows obtaining the effect assumed in the description of the subject of the contract by means of other technical solutions. The Contractor who invokes equivalent solutions, to the extent described by the Ordering Party, is obliged to demonstrate that the supplies and services offered by him meet the requirements specified by the Ordering Party. If the description of the subject-matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority will not reject the tender if the solutions proposed in the tender (proven by the Contractor by the means of the evidence in question) meet the requirements specified in the description of the subject-matter of the contract to an equivalent extent. The subject of the contract offered by the contractor must be complete, brand new, and have all the elements listed in the description of the subject of the contract. The subject-matter of the contract offered by the contractor must meet the minimum technical, qualitative and functional parameters and must not be worse technically and qualitatively than specified in the description of the subject-matter of the contract – it must be at a level (equivalent) or better than specified in the description of the subject-matter of the contract, and its use will not in any way adversely affect the proper functioning of the technical/functional solutions provided for in the described equipment parameters. Any proper names and names of manufacturers used in the description of the subject of the contract are given, for example, and serve only to determine the parameters of the ordered devices, equipment and equipment, quality, technical and functional standards and cannot be treated as a recommendation for their purchase and use. They do not serve to select or prefer a specific manufacturer or supplier. Technical, quality and functional parameters indicated in the description of the subject of the contract, the Ordering Party treats as a determination of not inferior (minimum) requirements of technical, quality and functional parameters. In accordance with Article 462 of the Public Procurement Act, the Contracting Authority allows the Contractor to be subcontracted. The Contracting Authority shall request the Contractor to indicate, in the tender, the parts of the contract which it intends to subcontract and to indicate the names of any subcontractors if they are already known in accordance with Art. 2 of the PPL Act. In accordance with Art. 1 and 2 and Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Regulation) (Official Journal of the European Union No. OJ L119 of 4 May 2016, p. 1 as amended), hereinafter referred to as ‘GDPR’, we would like to inform you that: 1) The administrator of your personal data is the Provincial Sanitary and Epidemiological Station in Warsaw represented by the Mazovian State Provincial Sanitary Inspector / Director of the Provincial Sanitary and Epidemiological Station with its registered office in Warsaw at ul.
