The subject matter of the contract includes the following activities:
(A) Exercise of construction supervision during construction, in accordance with Article 166 (1) (1) of the ZUT (until the issuance of the Permit for Use), within the mandatory scope laid down in Article 168 (1) of the ZUT:
— the lawful start of the construction;
— monitoring the completeness and proper drafting of documents and protocols during construction;
suspension of construction works carried out under the conditions laid down in Articles 224 (1) and 225 (2) of the ZUT and in breach of the requirements. 169 (1) to (3) of the ZUT;
— monitoring compliance with occupational health and safety requirements in construction;
— preventing damage to third parties and property as a result of the construction;
— suitability of the construction for placing in service.
(B) Signature of all acts and protocols during construction necessary for the assessment of the works, in accordance with the safety requirements and their lawful implementation, in accordance with the ZUT and Regulation No 3/31.7.2003 on drawing up acts and protocols during construction;
(C) Opening the construction site and defining the construction line and level, in the presence of the persons referred to in Article 223 (2) of the ZUT, when drawing up the necessary protocol under Regulation No 3 of 2003 on drawing up acts and protocols during construction;
(D) Certificate of the Order for Construction and written notification within 7 days of certification of the Municipality, the specialised inspection bodies, the Regional Directorate for National Construction Control, the RSPBS and the Labour Inspectorate.
(E) Performance of the functions of the coordinator for safety and health for the construction phase in accordance with Article 5 (3) of Regulation No 2/2004 on minimum health and safety requirements for the execution of construction and installation works, including the fulfilment of all the obligations of the contracting authority laid down in this Regulation.
(F) Provision to the contracting authority of monthly reports and a final report on the supervision carried out during the execution of the construction works, containing: a list of the main activities (types of works) of the works for which supervision has been carried out on an ongoing basis, the documents (acts) drawn up, as well as information on problems encountered (if any) and the measures implemented and/or necessary to resolve them, as appropriate.
(G) Preparation of a final report on the construction, in accordance with Article 168 (6) of the ZUT, for the issue of an authorisation for its use, including a technical passport for construction, in accordance with Regulation No 5 of 2006 on technical passports for construction works. The final reports and technical passports for all construction works are presented in 3 (three) paper originals and 2 (two) copies in electronic form.
(H) Submission of the final reports to the municipal administration.
