The subject of the Order is the supply of couplings for subway vehicles of the Varsovia type in the years 2025-2026. The detailed description of the Subject of the Contract is specified in the Technical Specification and its annexes (hereinafter: ‘ST’), which constitutes Annex 1 to the SWZ. The subject of the Order will be carried out in accordance with the documentation of the procedure, i.e.: SWZ and its annexes, in particular ST and model contract (Annex 2 to SWZ). Whereas: 1) As a result of the public procurement procedure conducted under an open tender procedure, the Contracting Authority purchased subway vehicles of the Varsovia type from Škoda Transportation Group (which is a constructor and manufacturer of vehicles) without a licence to produce them (due to the costs of such a procedure) together with the certificate of entry into service of vehicle type No PL 59 2023 0059, issued by the President of the Office of Rail Transport. In connection with the above, the Ordering Party has not received and does not have the construction and production documentation of vehicles or their parts; 2) the use of parts other than those indicated in the RVU annexed to the RVU, for which the vehicle retrofit procedure described on the above-mentioned pages has not been carried out. the Office of Rail Transport would infringe the documents on the basis of which the type tests of vehicles that were the basis for their entry into service and safe carriage of passengers were carried out; The Ordering Party is not able to describe the subject of the Order in the manner referred to in art. 4 of the Public Procurement Act, i.e. without indicating the trademarks (producer's catalog numbers) and the use of the manufacturer's catalog numbers is justified by the specificity of the Subject of the Order. In view of the above, in accordance with Art. 5 of the Public Procurement Act, the Ordering Party allows the submission of an offer for products equivalent to those indicated by the Ordering Party. Where equivalent parts are offered, they shall have the same characteristics as the original parts while meeting the functional requirements of the original parts and shall be compatible with the other components of the vehicle. The Contracting Authority requires that the manufacturer of equivalent parts has implemented a Quality Management System in his company. The contractor who offers the supply of equivalent parts together with the tender will provide the means of proof referred to in point 12 of the CVT. If the Contractor fails to submit the evidence in question or the evidence submitted by him is incomplete, the Contracting Authority, acting in accordance with Article 107(2) of the Public Procurement Act, will call for it to be submitted or supplemented within the prescribed period.
