Contract for supply, installation, commissioning and service during the warranty period in order to purchase BEDS FOR AUTOCLAVABLE MOBILE MECHANICAL PATIENT:
Procedure for the award of the public contract relating to the ‘Provision of mobile mechanical patient beds financed from non-reimbursable European funds – project – rebirth of the Gaesti hospital’, SMIS code: 140641, is initiated under a suspensive clause, given that the funds will be provided after the approval of the application for financing the project with non-reimbursable European funds, Large Infrastructure Operational Programme 2014-2020, Priority Axis 9 “Protection of the health of the population in the context of the pandemic caused by COVID-19”, Specific Objective 9.1. CONSOLIDATION OF THE COVID-19 SANTA CRISIS MANAGEMENT CAPACITY’, in the sense that the conclusion of the public procurement contract is conditional on the allocation of the necessary funds for this purpose from the LIOP funds, the signing of the contract being done in compliance with the provisions regarding the commitment of the expenditures from the budgets falling under the legislation on public finances.Given the provisions of Law 98/2016 on public procurement and Government Decision No 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will be ensured by allocating the budget appropriations for this purpose. If, for any reason, the budget appropriations will not be allocated, the Contracting Authority, after receiving the notification of non-granting, reserves the right to cancel the award procedure, provided that there is no other source of funding in accordance with the second sentence of Article 212(1)(C) of Law 98/2016, as amended, making it impossible to conclude the public procurement contract. The tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage. The bidders in this procedure accept the use of the above special conditions/suspensive clauses, assuming full responsibility for any damage they may suffer in the Evaluation Factors are:
Full guarantee period : min 24 months from the date of commissioning.
The maximum delivery time is 60 calendar days from the date of signing the contract.
The number of days until which clarifications can be requested before the deadline for submission of tenders is 11 days, according to Article 160 of Law 98/2016. The contracting authority will respond to all requests for clarifications / additional information on the 6th day before
the deadline set for the submission of tenders, in accordance with Article 161 of Law No 98/2016.
