Description

1. The subject of the contract is the supply of head assemblies for electric traction vehicles EN76 and 48EC/48WEb, the type, description and terms of delivery of which are specified in Annex No 2.1 (Price form) and Annex No 4 (Model contract) to the FTZ. 2. The parts offered must: - strictly comply with the requirements set out in Annex 2.1 to the FTZ, - be original, brand new, free from defects, meet the relevant quality requirements and the requirements of European standards or Polish Standards transposing European standards, as well as not burdened with the rights of third parties, - meet the requirements set out in the Model Agreement. 3. Contractors may apply for the award of a contract if they: 1) are not excluded in the circumstances referred to in Art. 1 of the Public Procurement Act, with the proviso that in the Proceedings the contractor is not subject to exclusion in the case referred to in Art. 1 point 1 letter h of the Public Procurement Act, and in the case referred to in Article 108 sec. 1 point 2 of the Public Procurement Act, if the person referred to in this provision has been convicted of the offence listed in Article 108 sec. 1 point 1 letter h of the PZP Act, moreover, they are not excluded in the circumstances referred to in: Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine U. EU. L. of 2014, No 229, p. 1 as amended; hereinafter referred to as "Regulation 833/2014"), - Article 7 para. 1 of the Act of 13 April 2022 on special arrangements to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2022, No. Journal of Laws of 2025, item 514 as amended; hereinafter referred to as the ‘Sanctions Act’); 2) meet the conditions for participation in the Proceedings specified by the Ordering Party.
