Post-warranty service of equipment (hereinafter also referred to as ‘post-warranty service’) The subject of post-warranty service of equipment is the elimination of defects in equipment which are no longer covered by any form of warranty (i.e. neither a statutory quality guarantee nor a contractual guarantee) and the list of which is set out in Annex 1 to the Treaty ‘Price table and list of equipment’ (hereinafter also referred to as ‘Annex 1’) or other equipment not listed in this Annex 1, see Article IV(4)(g) of the Terms and Conditions. Within the post-warranty service of the equipment, the supplier is obliged to remove defects of the equipment, in the place where the equipment is located, by replacing defective spare parts or components with new ones. 2. Equipment warranty service (hereinafter also referred to as ‘guarantee service’) The object of equipment warranty service is to ensure the removal of defects in equipment covered by a quality guarantee, i.e. to ensure the removal of defects within the warranty period. As part of the warranty service, the Supplier is obliged to take all necessary actions in a proper and timely manner to exercise the Customer's rights under the warranty, i.e. in particular to make a complaint about the defect and request its removal by repairing the equipment free of charge or replacing the equipment with a new one (if repair is not possible) in accordance with the terms of the warranty for the relevant equipment. The warranty service includes, among other things, the removal of the equipment from the place where it is located to perform warranty repairs and the subsequent return of the equipment back to the place from which the equipment was taken; at the expense and risk of the supplier.
