1. The subject of the contract is the supply of the necessary resources for the performance of civil protection and civil protection tasks. The task was co-financed from a special-purpose grant from the Mazovian Voivode's budget as part of a grant for local government units for the implementation of tasks in the field of civil protection and civil protection for 2025. The contracting authority reserves the right to cancel the procurement procedure if the public funds that the contracting authority intended to allocate to financing are not granted to it, the possibility of cancelling the procedure on this basis is provided for in the contract notice. 3. The subject-matter of the contract must meet the minimum requirements set out in the FTZ and its annexes, in particular in the CIP. In addition, the Ordering Party reserves that the equipment and equipment being the subject of delivery: 1) are brand new, unused, not subject to any repairs, full-value, complete, free from defects, including design, material, executive and legal defects, and in addition complying with the technical requirements specified by the applicable regulations and standards in Poland, 2) may not be encumbered with bond or property law for the benefit of third parties or entities, they are not subject to enforcement, court proceedings or before any adjudicating authority and are not subject to security. 4. A detailed description of the subject of the contract is set out in Annex 1 to the FTZ. 5. If trade marks, patents or origin, source or a specific process that characterises the products or services provided by a particular Contractor are used in the description of the subject of the contract in particular in the FTZ or its annexes, they are only illustrative, they specify the minimum quality parameters and performance characteristics that must be met by the supplies in order to meet the requirements set by the Ordering Party. It should be assumed that they are only indications and are intended only to clarify the level of expectations of the Ordering Party in relation to a specific solution, and the Contractor is not obliged to apply them. In accordance with Art. 4 of the Public Procurement Act in the event that the FTZ or its annexes contain a reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101 sec. 1 point 2 and paragraph. 3 PPL and such references were not accompanied by the expression "or equivalent", the Contracting Authority allows solutions equivalent to those described in each such standard, European technical assessment, approval, technical specification, technical reference system. In accordance with Art. 5 PPL The Contractor who relies on solutions equivalent to those described in these documents is obliged to prove, by attaching to the tender the appropriate means of proof referred to in Articles 104 to 107 of the PPL, that the proposed solutions meet the requirements specified in the description of the subject-matter of the contract in an equivalent manner. 6. The Contractor is obliged to perform the subject of the contract in accordance with the FTZ, its annexes and applicable norms and standards. 7. The Contractor declares that he has the knowledge and experience to ensure proper performance of the subject of the contract. 8. A detailed description of the subject of the contract specifying, in particular, the quantity, parameters and requirements of the Ordering Party as to the subject of delivery is included in the description of the subject of the contract (Annex 1 to the FTZ).
