Description

1. The subject-matter of the contract is the provision by the Contractor to the Contracting Authority of a comprehensive supply of gaseous fuel in the form of high-methane natural gas (Group E), consisting of a sale.
gaseous fuel and provision of the service for its distribution to installations located at the Contracting Authority’s premises, hereinafter referred to as ‘receipt sites’, the list of which is set out in Annex 2 to the ToR.
2. The total amount of gaseous fuel to be delivered during the duration of the Agreement to the take-back sites specified in Annex 2 to the ToR is estimated at 20 679 911 kWh.
3. The indicated volume of gaseous fuel as specified in point. 2 is the value estimated on the basis of previous consumption. The procurer reserves the right to reduce or increase the aggregate
the volume of gaseous fuel, in relation to the quantity specified in point. 2. Any change in the estimated consumption as defined in point. 2 will not result in additional costs for the Contracting Authority other than the settlement for
the amount of gaseous fuel actually consumed.
4. The procurement of gaseous fuel in individual gas months and the contract power order are set out in Annex 2 to the ToR.
5. The comprehensive supply of gaseous fuel will take place under the conditions laid down in the Energy Law Act of 10.4.1997 (consolidated text: Of Laws 2012, item 1059 as amended) and
in accordance with the implementing provisions of that law.
6. The service for the distribution of gaseous fuel to the receiving site will be carried out through a distribution network belonging to the local DSO – Polska Spółka Gazownictwo Sp. z o.o., with its registered office in Warsaw, Oddział w Tarnów.
7. Requirements for the Contractor:
The contracting authority will grant the selected Contractor a power of attorney to:
7.1. notification, on behalf of the contracting authority, of the comprehensive supply of gaseous fuel to the Distribution System Operator in order to carry out the comprehensive supply of gaseous fuel,
7.2. termination of existing contracts for comprehensive supply of gaseous fuel or declaration of termination of contracts for the comprehensive supply of gaseous fuel in accordance with the agreement
Parties,
7.3. complete all actions and arrangements with the DSO and the outgoing seller necessary to carry out the switching procedure and effectively start a comprehensive supply of fuel
gas.
