1. The subject of the contract is the supply of reagents necessary to conduct microbiological diagnostics for the needs of the Multi-specialist Hospital in Inowrocław for a period of 36 months from the date of signing the contract. 2. A detailed description of the subject of the order is attached as Appendix No. 2 to the SWZ (Packages No. 1 to No. 10). 3. In proceedings above the EU thresholds conducted in an open tender procedure, in which the contracting authority applied an accelerated deadline for the submission of tenders (Art. 2 point 2 of the Public Procurement Act – urgent need), the rules for asking questions and providing explanations to the FTZ are being shortened 4. The duration of the contract specified for 36 months may be extended by the Ordering Party in the event that the Ordering Party has not used the quantity of the assortment specified by the subject of the contract. 5. The quantities set out in Annex 2 constitute estimated annual consumption and may be reduced to 20% of the unused , quantity, without giving rise to an obligation on the part of the Contracting Authority to implement the , in full or to the Contractor’s claim for compensation for failure to use the maximum value of the contract. 6. Without excluding the application of the provisions of para. 4, The Buyer reserves the right to change both between items in a given package and the assortment between packages within the limits of 50% in relation to the quantity specified in Annex No. 2 while maintaining the prices specified in this Annex. Changes must not result in an increase in the overall value of the contract. The above circumstances do not require the conclusion of an annex to the contract and will be made in the orders referred to in § 2 sec. 1 7. The contracting authority allows partial tenders to be submitted. a. The products offered must have the required certificates of approval for use in the public health service. b. The quantities given in Annex 2 constitute estimated consumption for a period of 36 months and may be reduced to 20% of the unused quantity, without constituting an obligation on the part of the contracting authority to fully implement it, or a basis for the contractor to claim compensation for failure to use the maximum value of the contract. 8. The Contractor is obliged to execute the order on the terms and conditions described in the model contract constituting Annexes No 5 to the FTZ. 9. The contracting authority does not allow variant offers to be submitted 8. The deadline for completing the current order – up to a maximum of 5 days from the date of placing the order. Urgent orders to be completed in a maximum of 72 hours 9. Warranty and warranty a. Required term of validity of the contract object () reagents – min. 2/3 of the term specified on the packaging by the manufacturer b. Required warranty period for the contract object made – 24 months. 11. The Ordering Party does not reserve the obligation for the contractor to personally perform works related to the subject of the contract.
