The subject-matter of this contract is the supply, together with the installation of two sequences on the magnetic resonances held by the Ordering Party for the Maria Skłodowska-Curie National Institute of Oncology – National Research Institute, Gliwice Branch. 2. The subject-matter of the contract includes the supply of data acquisition – a solution described below with its installation on two Siemens MAGNETOM Prisma (s/n 66026) and Siemens MAGNETOM Vida (s/n 175653) apparatus owned by the Ordering Party. Sequences must be compatible with existing resonances and the programming version on both resonances This data acquisition type MR Fingerprinting (MRF) or equivalent, i.e. allowing to obtain data from a single sequence on magnetic resonance, as a result of which different tissues have a unique set of quantitative parameters describing them with the measurement of the relaxation time T1 and T2 of different tissues. Obtained parameters from the acquisition analyzed on the post-processing server owned by the Ordering Party (syngo.via min version VB60s) creating maps (using pattern recognition methods) of tissues and maps of tissue properties allowing for potential identification of pathology. Tissue properties obtained must include relaxation time T1 and T2. In addition, the description of the subject of the contract and the conditions for the performance of the contract are contained in the annexes: 1) Price schedule – Annex 2 to the SWZ, 2) Draft provisions of the contract, which will be included in the content of the contract – Annex 4 to the SWZ 3. Tenders not containing the full scope of the subject of the contract will be rejected. 4. The contracting authority allows equivalent tenders to be submitted - the description of equivalence is contained in Chapter IV of the SWZ. 5. The Contracting Authority does not provide for electronic auctions or supplementary contracts. 6. Information on joint bids by contractors is provided in Chapter IX of the SWZ. 7. The Contracting Authority provides for the possibility of changing the provisions of the concluded agreement (so-called contractual changes based on Art. 1 point 1 of the Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions set out in Annex 4 to the SWZ. An information clause resulting from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, was included by the Ordering Party in the SWZ. 9. The successful tenderer shall be required, before the conclusion of the public contract, to lodge a performance guarantee equal to 5 % of the total price quoted in the tender. 10. The contracting authority informs that the contract must comply with the ‘DNSH principle’ (‘do no significant harm’; Eng. ‘Do No Significant Harm’), which is the principle of not supporting or conducting an economic activity that causes significant harm (serious harm, has significant negative impacts) to any of the environmental objectives such as (1) climate change mitigation, (2) climate change adaptation, (3) sustainable use and protection of water and marine resources, (4) circular economy, (5) pollution prevention and control, (6) protection and restoration of biodiversity and ecosystems 11. The contracting authority informs that the subject of the contract in this procedure is carried out under the project ‘Use of radiogenomics in genotype determination of primary brain tumours using multiparametric magnetic resonance imaging with particular emphasis on spectroscopy (1H-MRS) aimed at detecting the oncometabolite 2-hydroxyglutarate (2HG)’ and co-financed under the National Recovery and Resilience Plan Component D Efficiency, accessibility and quality of the health care system Investment D3.1.1 Comprehensive development of research in the field of medical sciences and health sciences 12. Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority provides for the possibility of cancelling the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not awarded to it. 13.
