Conclusion of a framework contract for the supply of non-marked police SUVs

1. The subject of the contract is the conclusion of a framework contract for the supply of SUVs in the unmarked police version. 2. The proceedings have not been divided into parts. The framework contract covers the supply of vehicles up to a maximum of 150 units over a period of 24 months under the framework contract. 3. The Ordering Party requires that the vehicles offered and delivered by the Contractor meet the conditions specified in Annexes 1.1, 1.2, 1.3 and 1.4 to the FTZ, and in the Contractor's tender submitted in the procedure for the conclusion of a framework contract, which is attached to the framework contract. 4. The Contract requires that the vehicles offered and delivered by the Contractor be manufactured in the year of their delivery or were manufactured in the year preceding their delivery and: a) hold type-approval certificates appropriate to the type of vehicle concerned, issued in accordance with the provisions of the Act on the Protection of Vehicles (Journal of Laws No. 14.04.2023 on vehicle approval systems and their equipment (Journal of Laws 2023, item 919) or the EC certificate of conformity for a complete vehicle, (b) were free from defects, (c) came from a legal source and were intended for use in the EU and in the territory of the Republic of Poland, (d) were the exclusive property of the Executive Order, were not encumbered with a lien, registered pledge or other rights of third parties, (e) no proceedings were pending in respect of vehicles. 5. The Agreement provides for the conclusion of a framework contract with 5 Contractors, whose tenders will prove to be the most advantageous among all submitted tenders, after awarding points in accordance with the criteria for the evaluation of tenders, specified in Chapter II of the Agreement. XIX SWZ. 6. The conditions for the performance of the contract are described in appendix 2 to the FTZ – PPU and appendix 2 to the PPU. 7. In the context of the condition set out in Article 100 of the Public Procurement Act, regarding accessibility for persons with disabilities, referred to in Directive 2014/24/EU of the European Parliament and of the Council of 26.022014 on public procurement (OJ L 94, p. 65), the transport of these persons will be carried out by other vehicles adapted to such transport as part of the equipment owned by the Police or through medical assistance authorised to transport disabled persons. Zamaw. included in the description of the subject of the contract the required features of the product (vehicle), including adaptations to the needs of all users. Employees of Zamaw. who will use the vehicle are not disabled. 8. Employment requirements on the basis of an employment relationship (Article 95 of the Public Procurement Act). The activities related to the execution of orders do not consist in the performance of work in the manner specified in Article 22(1) of the Act on Civil Procedure. 26.06.1974 Labour Code (i.e. Journal of Laws of 2025, item 277, 807). 9. Place of delivery: Transport Department of the Provincial Police Headquarters in Wrocław, ul. gen. I. Połbina 1, 54-151 Wrocław. 10. Equivalent tenders: Whenever in the FTZ and annex, the subject of the contract or part of it has been determined. by indicating trademarks, patents or origin, technical assessments referred to in Art. 4 of the Public Procurement Act, the source or specific process that characterizes the products or services provided by a particular Contract, if this could lead to privileges or eliminations of certain Contracts or products, the intention of Zamaw. was to present the "type" of the material or technology, source or specific process. In this case, Zamaw. allows the submission of equivalent tenders at the same time indicating in the description of the subject-matter of the contract. the expression "or equivalent" and the criteria used to assess equivalence. In the case of the description of the subject-matter of the order by means of standards, technical assessments, technical specifications and technical reference systems, it should be assumed that minimum requirements (technical, qualitative or functional standard) have been specified and, at the same time, the Contractor has been allowed to adopt solutions equivalent to those described, and such a reference is accompanied by the words ‘or equivalent’. 11. Execution. may entrust the execution of orders. subcontractors. Zamaw. does not reserve the obligation for the Contractor to personally perform the key parts of the order. In the case of performance of the subject of the order. using subcontractors, Zamaw. requires the Contractor to indicate those parts of the order. the performance of which he intends to entrust to subcontractors and to provide the proposed subcontractor companies (part II, section D of the JEDZ document) - if they are known to him at this stage. 12. The rules for the award of implementing contracts are set out in Paragraph 2 of the Framework PPU. See also chapter. V, the mouth. 13 of SWZ. 13. Term of the framework contract: 24 months from the date of its conclusion. 14. Deadlines for the implementation of implementation contracts under individual calls will be indicated in the implementation procedures. 15. The procedure is conducted with a view to concluding a framework agreement under Article 132 – open tender procedure, in conjunction with Article 311(1)(b) and (c) EUTMR. 1 point 1 of the PPL Act. 16. Contracting authority: a) does not provide for the application of the procedure referred to in Article 139 of the Public Procurement Act, the so-called Public Procurement Act. ‘reverse procedure’, (b) does not allow variants, (c) does not provide for the award of contracts referred to in Article 214(c). 1 point 8 of the Public Procurement Act, d) does not provide for or require an on-site inspection or verification of the documents referred to in Article 131 sec. 2 of the Public Procurement Act, e) does not provide for the selection of the most advantageous offer from the use of electronic auction (Article 308 sec. 1 of the Public Procurement Act), f) does not provide for the application of the option right, g) does not provide for the reimbursement of costs of participation in the proceedings, h) provides for the granting of advances for the execution of orders. 8 of the draft implementing agreement, i) does not reserve the possibility of applying for a contract only by the Contractor, referred to in Article 94 of the Public Procurement Act, j) does not specify the requirements for the employment of persons referred to in Article 96 sec. 2 pts. 2 p.p. 17. Execution. will be bound by the offer for a period of 90 calendar days. The first day of the time limit for the submission of tenders shall be the day on which the time limit for receipt of tenders expires. 18. Required security 230000,00 zł. 19. Zamaw. does not require the provision of a security for the proper performance of the contract. 20. GDPR information clause - ch. II SWZ. 21. Acceptable changes: a) framework agreement - ch.
