1. Construction of the Westerplatte and War 1939 Museum – Branch of the Museum of the Second World War in Gdańsk’ – scope 2. The scope of the contract covers the execution of construction works and the completion of the construction procedure referred to in Chapter 5c of the Construction Law Act (Journal of Laws No. U. 2025 item 418 as amended) [Construction Law] for an investment project covering the implementation of the scope II of the investment entitled ‘Construction of the Museum of Westerplatte and the War 1939 – Branch of the Museum of the Second World War in Gdańsk – scope 2’. 1.1. The material scope of the contract includes all works, activities and works necessary for the performance of the investment task, including the following elements: • Construction of a two-storey, underground Main Building of the Museum with a usable area of 7 051.54 m, • Construction of a fire road with a manoeuvring area for a fire truck, • Reconstruction of historical communication routes, • Reconstruction of the historical cannon station, • Reconstruction of the relic of Popielnik, • Restoration of the buildings: Coast Defenders Monument, Guardhouse No. 3, southern wing of the New Barracks – permanent ruin, Monument 7 Candles, • Reading outline of objects: Mikołajewo, Non-commissioned Villa, North Wing of New Barracks, Old Barracks, Non-commissioned Casino, Monument to the 10th Anniversary of Regaining Independence, • Preservation of the existing inscription ‘Never again war’, • Execution of elements of small architecture, • Demolition of objects: i.a. reinforced concrete nests of the outdoor exhibition, elements of the IS-2 tank, ahistoric communication routes, ahistoric terrain stairs, ahistoric buildings, reinforced concrete shed and sales pavilion, southern parking lot, flag poles, concrete information boards, steel stands, elements of small architecture, • felling trees and making replacement plantings, • Construction and reconstruction of external networks, • carrying out the procedure for completing the construction referred to in Chapter 5c of the Construction Law Act. 2. The subject-matter of the contract is described in detail in Annex 1 to the FTZ ‘Description of the subject-matter of the contract’ (OPZ) and in the technical and design documentation (forming Annexes 1 to 4 to the FTZ), as well as in the model contract constituting Annex 7 to the FTZ. 3. The Contractor will provide a minimum of 60 months guarantee for the subject of the contract, counting from the date of signing the final acceptance report. Irrespective of the guarantee provided, the Contractor shall, for a period of 5 (in words: five) years is liable under the warranty on the terms set out in Article 638 of the CC in conjunction with Article 656 of the CC in conjunction with Articles 556-576 of the CC for defects in the performance of the Works which are the subject of the Agreement. 4. The contractor whose tender is selected as the most advantageous will be required to have: • current civil liability insurance in the scope of activities related to the subject of the contract for the sum of insurance not less than PLN 50,000,000 for the entire duration of the contract (until the completion of works and their receipt); • current insurance of all construction and assembly risks / CAR insurance, EAR insurance, the subject of which will be contract works, which consists of the value of construction works performed for an amount not less than the net offer value and any materials used, construction equipment with construction facilities, as well as any existing property, located on the construction site and in its vicinity, with an insurance period starting from the date of handover of the construction site / site until the end of the contract works, confirmed by final acceptance. 5.
