The contracting authority intends to award an additional contract to the incumbent contractor. This additional assignment(s) concerns unforeseen additional work that has proved necessary during the execution of the original assignment. The additional work derives directly from the original contract and cannot be separated technically and economically without significant disadvantages for the contracting authority. Involving another contractor would lead to substantial technical complications, additional costs and/or serious delays in the implementation of the project. The need to carry out that additional work was objectively unforeseeable in the case of the contracting authority at the time when the initial contract was awarded. The additional contract is therefore covered by the exception referred to in Article 2.163e of the Procurement Act 2012.
