Description

The purpose of this notice is to conclude discount agreements under Section 130a(8) of the SGB V for the active substance(s) referred to in point II.1.1. This does not constitute public procurement within the meaning of Directive 2014/24/EU or Sections 97 et seq. of the GWB. Any pharmaceutical company may become a contracting party in accordance with Section 4(18) of the AMG. According to the case law of the CJEU, such admission procedures are not necessarily subject to public procurement law, as there is no competition due to the absence of a selection decision. The purpose of the notice is to encourage the conclusion of discount agreements with identical and non-complementary terms applicable to all contracting parties, including the determination of the rebate. The contract will be concluded by signing the contractual documents and providing the requested declarations, which may be requested from the contact point designated under I.3 below.
