Description

1. The subject-matter of the contract is the supply of computer servers, hereinafter referred to as ‘equipment’, for the IT Centre of the University of Gdańsk. 2. Common Procurement Vocabulary (CPV) Classification Code: 48822000-6 (computer servers). 3. A detailed description of the subject-matter of the contract was specified in the description of the subject-matter of the contract - Annex 6 to the FTZ. 4. Place of delivery of equipment: University of Gdańsk, Information Centre, Prof. Maria Janion 7, 80-309 Gdańsk. 5. The customer requires a warranty for the equipment for a period of 36 months. The details of the guarantee are set out in Section 7 of the draft contract – Annex 5 to the FTZ. 6. If anywhere in the FTZ, including in the description of the subject-matter of the contract – Annex 6 to the FTZ, the standards referred to in Article 101(1)(c) EUTMR are indicated. 1 point 2 and paragraph. 3 PPL, it should be understood that such indication is accompanied by the words ‘or equivalent’ and the Contracting Authority allows offering solutions equivalent to those described. Due to the fact that the possibility of different equivalent proposals is allowed, the Contractor is required to verify and treat all solutions as interlinked. Demonstration of equivalence, i.e. equivalent fulfilment of the requirements specified by the Employer in the description of the subject of the contract, lies with the Contractor. If equivalent solutions are used in the tender, the Contractor is obliged to indicate the relevant option in point 6 of the tender form – Annex 1 to the FTZ, and is also obliged to indicate in his tender which standards, to which the description of the subject of the contract refers, have been replaced and indicate what equivalent solutions he proposes in their place. The contracting authority will not reject the Contractor’s tender solely because the supplies offered do not comply with the standards to which the description of the subject-matter of the contract refers, provided that the Contractor proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107 of the Public Procurement Law, that the proposed solutions meet the requirements set out in the description of the subject-matter of the contract to an equivalent extent (Article 101(1)(b) EUTMR). 5 of PZP). 8. The Ordering Party, after signing the contract, provides for applying for a 0% VAT rate pursuant to Art. 14 point 1 of the VAT Act of 11 March 2004 (consolidated text: Dz.
