Description

3.1 The subject of the contract are successive deliveries of cleaning products for the needs of the kitchen for the Health Care Team in Bolesławiec along with transport and bringing to the place indicated by the Ordering Party. 3.2 The detailed description of the subject of the contract includes the Price Form - Appendix No. 2 to the SWZ. 3.4 The parameters described in Annex No. 2 to the SWZ as required technical and usage parameters constitute a detailed description of the subject of the contract, the non-fulfilment of which will result in the rejection of the offer as inconsistent with the terms of the contract pursuant to Art. 1 point 5 of the Public Procurement Act. 3.5 The goods offered must meet all the parameters specified in the SWZ and annexes as well as the quality requirements specified in the manufacturer's technical documentation for the product, be brand new (Category I), unused and free from defects and have the intact features of the original packaging, with the manufacturer's markings and catalog number (if any). The customer requires only professional goods and equipment. 3.6 The Contractor is obliged to provide the catalogue number in order to identify the offered goods. The catalogue number is an important element of the content of the offer for the Ordering Party due to the need to determine the compliance of the content of the offer with the SWZ, i.e. the comparison of the products offered by the Contractor with the parameters required by the Ordering Party. Lack of entry will result in rejection of the offer as non-compliant with the specification. 3.7 The name of the offered product constitutes the substantive content of the offer, because it serves to identify and specify the offered subject of the contract and the subsequent subject of the contract, and thus failure by the Contractor to provide the name of the product (the name given by the manufacturer) in the event that the Ordering Party required this name by the provisions of the specification, causes the content of the offer to be inconsistent with the content of the specification. The offer must not give the possibility of additional searches for its content, it must be unambiguous in order to be able to subject it to verification as to its compatibility with the content of the SWZ. 3.8 The subject of the contract offered must have appropriate certificates or attestations allowing their use in health care in accordance with Polish law and European Union law. 3.9 If the release for free circulation documents expire during the term of the contract, the Contractor must declare that the subject of the contract offered will have a current release for free circulation during the term of the contract. At each written request of the Ordering Party, the Contractor shall, within 3 days from the date of the request, provide copies of marketing authorisation documents in accordance with the Act on Medical Devices. 3.10 The Ordering Party does not allow submission of tenders for individual items. 3.11 Each Contractor may submit only one tender for the entire contract in writing, failing which it shall be null and void. If the Contractor submits more than one tender for the entire contract, all tenders of that Contractor shall be rejected by the Contracting Authority. 3.12 The Contracting Authority reserves the right to verify the reliability of the parameters provided by the Contractor in Annex 2 in all available sources, including by requesting additional explanations from the Contractor. 3.13 The Ordering Party requires the delivery with the subject of the order (with each batch, each product) a leaflet in Polish containing all the necessary information for the direct user, including the method of its storage, storage. 3.14 If the equivalence of the offered product with the one described by the Ordering Party is demonstrated, the Contractor must prove in the tender, in particular by means of the means of proof referred to in Articles 104 - 107 of the Public Procurement Law Act of 11 September 2019 (Journal of Laws of 2019, No. Journal of Laws 2024, item 1320) that the proposed solutions meet to an equivalent extent the requirements specified by the Contracting Authority in Annex No. 2 to the SWZ.
