Delivery of desktops, terminals and notebooks under a framework contract

1. The subject of the proceedings is the conclusion of a framework agreement, within the meaning of Article 7(26) of the PPL, between the Contracting Authority and the Contractors selected in these proceedings. 2. The Contracting Authority shall allow partial tenders to be submitted: - part 1 - PC1 desktops and/or terminals, - part 2 - NB1 and/or NB2 and/or NB3 notebooks. 3. The draft framework agreement, which constitutes Annex 10 to the FTZ, sets out the principles and method of awarding implementation contracts for the sale of the above-mentioned equipment to the Contracting Authority: - part 1 - desktop computers in PC1 configuration (set: central unit with operating system license and keyboard, mouse, USB headphones and monitor) and/or computer terminals (set: with a license for the operating system and a keyboard, mouse, USB headphones and monitor) in the total number of 24 000 devices estimated by the Ordering Party; - part 2 - notebooks in NB1 configuration (set: with operating system license and keyboard, mouse, USB headphones) and/or NB2 (set: with operating system license and keyboard, mouse, USB headphones, docking station and monitor) and/or NB3 (set: with a license for the operating system and a keyboard, mouse, headphones, docking station and monitor) in the total number of 1000 devices estimated by the Ordering Party. 4. A detailed description of the devices is contained in Annexes 3a, 3b, 3c, 3d, 3e to the FTZ. The devices must be brand new and must come from a legal and authorized sales channel. 5. The Ordering Party, in each of the parts of the contract referred to in paragraph. 2, conclude a framework contract with a maximum of 5 (five) Contractors, whose tenders will meet all the requirements set out in the FTZ and who have obtained the highest number of points in the tender evaluation criterion (the first five places in the ranking). In the event that less than 5 non-rejectable tenders are submitted in a given lot, the Contracting Authority shall conclude a framework contract with all Contractors who have submitted non-rejectable tenders. If, in a given lot, two or more tenders receive the same number of points (offers with the same price) and are ranked ex aequo in one position, the Contracting Authority will conclude a framework contract with all Contractors who have been ranked in the first five positions of ranking 6. Implementation contracts will be awarded during the term of the framework agreement, i.e. within 36 months from the date of conclusion of the framework agreement, as required by the Employer. 7. The implementation contract may be awarded only to the Contractor with whom a framework contract has been concluded. 8. In the implementation offer, the Contractors may not offer prices higher than those offered in the offer for the framework contract, subject to the possibility of adjusting prices.
