The notice concerns the conclusion of a framework contract with a maximum of one economic operator. (a) Mandatory requirement to submit a request to participate and tenders Applicants should contact the above-mentioned contact by e-mail, stating the company name, contact person (including telephone number and e-mail address) and tax identification number, in order to obtain information on how to access the call for tenders on the ARIBA platform. If you already have an ARIBA sourcing account, please also send us the AN-ID. Candidates are recommended to apply for this access as soon as possible and to click on ‘intend to participate’ on ARIBA for clarification from the procuring entity. The procuring entity does not guarantee applicants requesting access to ARIBA less than 48 hours before the closing date for receipt of requests to participate to provide ARIBA registration data before the closing date for submission. The applicant is solely responsible for requesting timely access to the ARIBA platform. The client assumes no responsibility for problems with the ARIBA platform. Any application that is not submitted correctly via ARIBA will be rejected. b) Interested companies may contact the awarding authority via the ARIBA platform with questions up to a maximum of 7 calendar days before the application deadline. Should the questions or answers be of general interest, they will be made available in anonymised form via the news function of the ARIBA platform. All interested companies/candidates are obliged to take the questions and answers into account when drafting their request to participate as well as their tender. Failure to do so may result in exclusion from the procedure. (c) General explanation of the content of the request to participate: c. 1) The contracting authority reserves the right to request the latest audited annual report or business information (not older than 6 months) available from the applicant. c. 2) Foreign applicants: In principle, they must provide the required declarations/evidence in German. If a declaration/evidence cannot be provided at all, this must be justified, a comparable declaration/evidence must be provided and - in German - why comparability exists. For documents that are not written in German, a certified translation into German must be enclosed. c. 3) Applicant associations: Together with the request to participate, they must submit a legally binding declaration of acceptance signed by all members and completed in full. In particular, the aspect of the conformity of the formation of the applicant community with antitrust law must be taken into account. Each member of the applicant community shall have the rights set out in 5.1.9. to submit the declarations and supporting documents required for the selection criterion "eligibility to pursue a profession" and for the selection criterion "economic and financial capacity". For the declarations and supporting documents under 5.1.9 Selection criterion "Technical and professional capacity", this applies to a limited extent if the applicant community provides for a division of tasks and in so far as, for example, certain references can only be submitted by one applicant community member; a limited submission of declarations and supporting documents, if any, is to be explained exhaustively by the applicant community in an annex to the applicant community declaration. Incidentally, the same rules apply to applicant groups as to applicants. c. 4) Other companies: Applicants can use other companies to prove their suitability (fitness loan). Then the other company must provide a declaration of commitment, according to which it will provide the applicant with a specifically defined partial service in the event of a contract. Both undertakings which confer suitability on the applicant (qualification lender and subcontractor) and, where possible, other undertakings which the applicant otherwise wishes to provide for performance (subcontractor) must be summarised in a list containing the name and registered office of the other undertaking and the part of the service for which the other undertaking is intended. The contracting authority reserves the right to reduce the number of bidders on the basis of the announced award criteria and to negotiate only with the most economical bidders.
