1. The subject of the contract is the successive delivery of liquid fuels to the service station of Miejski Przedsiębiorstwo Komunikacyjny w Siedlcach Sp. z o. o., located in the bus depot at ul. Starzyńskiego 20 in Siedlce, at the contractor's expense and risk, in the CPT (Franco) formula, i.e.: 1) diesel fuel, depending on the ambient temperature (period) respectively: standard, (b) with improved low-temperature (winter) properties; 2) unleaded gasoline Pb 95. 2. The fuels supplied shall meet the requirements of: 2.1. Regulation of the Minister for Climate and the Environment of 26 June 2024 on quality requirements for liquid fuels (Journal U. item 1018 as amended), in particular as set out in the Annexes to the Regulation; 2.2. standard PN-EN 590:2022-08 or equivalent – for diesel fuel; 2.3. standard PN-EN 228+A1:2017-06 or equivalent – for unleaded petrol Pb95; 2.4. be microbiologically clean and resistant throughout the year to possible microbiological contamination in tanks and service station installations. 3. Estimated size and purpose of the subject-matter of the contract: 1) Diesel oil: 3 200 000 litres (3 200 m3), of which: ‘Winter’ diesel fuel: OK. 120 000 litres (120 m3); 2. unleaded petrol Pb 95: 100 000 litres (100 m3). The quantities quoted include the contracting authority's estimated two-year fuel demand over the duration of the contract, which may be increased or decreased by up to 20% for each type of fuel, depending on the contracting authority's actual needs. The contracting authority requires that in the tendered subject of the contract, the share of products including software used in the equipment of telecommunications networks originating in the Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by virtue of a Council decision exceeds 50%. A product originating in a country should be understood as a product wholly obtained, i.e. produced in that country. Equivalent solutions: Wherever the subject-matter of the contract indicates a trade mark, patent, origin, source or specific process which characterises the products or services provided by a particular economic operator and which could lead to the favouring or elimination of certain economic operators or products, or where the subject-matter of the contract is described by reference to a specific standard, technical assessment, technical specification and technical reference systems established by the European standardisation bodies referred to in Article 101(1)(b) and (c) and (c) of Regulation (EC) No 207/2009. 1 point 2 and paragraph. 3 of the Act, and in any case, acting in accordance with Art. 6 and Art. 101 para. 4 of the Act, the contracting authority allows solutions equivalent to those described, marking such indications or references with the expression ‘or equivalent’. An economic operator relying on equivalent solutions shall be required to demonstrate that the solution offered by it satisfies the requirements specified by the contracting authority to an equivalent extent. Any costs arising from these differences shall be borne by the Contractor. The Contractor shall also attach to the tender a list of equivalent solutions, as appropriate, together with its description or standards. The template for the tender form has been developed on the assumption that the contractor will not invoke equivalent solutions. If the economic operator invokes equivalent solutions, it must modify the content of the form accordingly or attach to the tender form a ‘Statement on the use of equipment/materials equivalent to those indicated in the procurement documents’.
