Winter maintenance of provincial roads administered by the Provincial Roads Administration in Opole in the winter seasons 2026/2027 and 2027/2028 by task
1. The subject of the contract is the ‘Winter maintenance of provincial roads administered by the Provincial Road Administration in Opole in the winter seasons 2026/2027 and 2027/2028 by task’ in accordance with the terms of the SWZ. Code and name of the Common Procurement Vocabulary: 90.62.00.00-9 – snow removal services; 90.63.00.00-2 – Ice removal services. 2. The subject of the contract is the provision of services related to snow removal and winter slipperiness removal, on provincial roads in the winter seasons 2026/2027 and 2027/2028, divided into 10 tasks. Main aspects of the procedure: 1. The contracting authority will apply the procedure referred to in Art. 1 of the PPL Act (i.e. the so-called reverse procedure). 2. The contractor must submit, together with the tender, a declaration of non-exclusion and compliance with the conditions for participation in the procedure in the form of a European Single Procurement Document (ESPD). 3. In the case of joint competition between economic operators, the declaration referred to in point 2 shall be submitted together with the tender by each of the economic operators jointly applying for the contract. This declaration confirms the absence of grounds for exclusion and compliance with the conditions for participation in the procedure to the extent that each economic operator demonstrates compliance with the conditions for participation in the procedure. 4. The contractor, in the case of reliance on the capacities or situation of the entities making resources available, shall also provide the declaration referred to in point 2 of those entities confirming that there are no grounds for excluding those entities and that the conditions for participation in the procedure or the selection criteria, to the extent that the contractor refers to their resources, are adequately fulfilled. 5. The contractor may confine itself to submitting in Section α of Part IV Eligibility Criteria a general declaration of compliance with all selection criteria in the procedure, in which case the contractor shall not complete any of the other sections (A to D) of Part IV EAT. 6. An economic operator in relation to which the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine apply shall also be excluded from the procurement procedure. 7. At the request of the contracting authority, the contractor is obliged to submit subjective evidence in accordance with the FTZ. In order to confirm the contractor's compliance with the conditions regarding technical or professional capacity referred to in point 4.4 of the FTZ, the contracting authority in accordance with Art. 1 of the Public Procurement Law Act, before selecting the most advantageous tender, will call on the contractor whose tender has been the highest rated to submit within the specified time limit, which shall not be less than 10 days, valid on the date of submission of subjective evidence: a) a list of persons referred by the contractor to perform the public contract, in particular those responsible for the provision of services, together with information on the scope of their activities and information on the basis for their disposal – the list of persons is attached as Annex 8 to the FTZ and should contain detailed information and data necessary to assess the conditions for participation in the procedure referred to in point 4.4.1 of the FTZ, i.e.: – for the person indicated in point 4.4.1 of the FTZ (service coordinator), enter his/her name, provide information on the basis on which he/she has access to that person (if a tender is submitted for more than one task, the contractor is obliged to designate another person for each task), (b) list of tools, plant equipment or technical equipment available to the contractor for the performance of the public contract together with information on the basis on which those resources are available – the list of tools is attached as Annex 9a to 9j to the FTZ and should contain the detailed information and data necessary to assess the conditions for participation in the procedure referred to in points 4.4.2.1 to 4.4.2.10) of the FTZ (i.e. the name and number of equipment units) and provide information on the basis on which equipment units are available. 8. Information on anticipated contracts referred to in Art. 1 point 7 of the Public Procurement Law Act: The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Act, consisting in the performance of identical services as those performed under the basic contract for a given task, i.e.: ‘Winter maintenance of provincial roads administered by the Provincial Road Administration in Opole in the winter seasons 2026/2027 and 2027/2028by task’, for tasks 1-10. These contracts will be awarded where: - the funds earmarked for the implementation of the basic contract will be used, - after 15.04.2028 weather conditions will prevail requiring winter maintenance of roads and the funds earmarked for the implementation of the basic contract will be used, - when, due to an ongoing tendering procedure or other obstacles, the implementation of works related to winter maintenance of roads in the winter season 2028/2029 will not be secured. During the performance of the contract referred to in Article 214(1)(7) of the Public Procurement Act, contractual penalties will apply as for the basic contract. 9. The contracting authority may cancel the procurement procedure if the public funds which the contracting authority intended to use to finance all or part of the contract have not been allocated to it. 10. The tender must be secured by a security lodged before the deadline for submission of tenders in the amount of PLN 272,000.00, including: for Task No 1 – PLN 18.000,00, - for Task No 2 – PLN 19.000,00, - for Task No 3 – PLN 21.000,00, - for Task No 4 – PLN 26.000,00, - for Task No 5 – PLN 25.000,00, - for Task No 6 – PLN 15.000,00, - for Task No 7 – PLN 28.000,00, - for Task No 8 – PLN 33.000,00, - for Task No 9 – PLN 49.000,00, - for Task No 10 – PLN 38.000,00. 11.
