1. The subject of the contract is the service of transporting patients moving independently to / from the Dialysis Station. 2. Item name according to the Common Procurement Vocabulary: CPV 60130000-8- specialised passenger transport services, CPV 60170000-0- hire of a passenger transport vehicle with driver. 3. A detailed description of the subject-matter of the contract, the estimated quantities and the conditions under which the subject-matter of the contract will be carried out are set out in annexes (description of the subject-matter of the contract, draft contract, tender form). 4. As part of the service provided, the Contractor is obliged to apply and comply with the applicable provisions of law, have appropriate powers and bear full responsibility in the event of their violation. 5. On the basis of Article 95 para. 1 of the Public Procurement Act, the Employer requires employment by the Contractor or subcontractor on the basis of an employment contract within the meaning of the Labour Code of 26 June 1974 (Journal of Laws No. Journal of Laws 2019, item 1040, 1043 and 1495 as amended) continuously throughout the term of the Contract of persons performing activities related to the implementation of the subject of the contract. 6. At the latest before the conclusion of the contract, the Contractor shall provide the Ordering Party with a statement on compliance with the requirement referred to in paragraph. 5, i.e. that the person/persons performing activities related to the performance of the subject of the contract will be employed under an employment contract within the meaning of the Labour Code Act of 26 June 1974. 7. At each stage of performance of the contract, the contracting authority has the right to verify the contractor's/subcontractor's statement (concerning the form of employment of the persons referred to in para. 5). To that end, it is entitled, in particular, to request the competent labour inspectorate to carry out an inspection. 8. The Contracting Authority does not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 9. The Contracting Authority does not impose the requirements referred to in Article 96 of the Public Procurement Act. 10. The Contractor is obliged to have voluntary third party liability insurance of the value indicated in the draft contract. At the latest before the conclusion of the contract, the Contractor shall provide the Contracting Authority with documents confirming compliance with this requirement.
