Supply of medicines - medicinal products and foodstuffs for particular nutritional uses, including enteral and parenteral nutrition

1. The subject of the contract are the supply of medicines for the needs of the Hospital Wards of the Międzyleski Specialist Hospital in Warsaw. 2. The subject of the contract has been divided into 200 Tasks, in the quantities and assortment indicated in the Price Forms attached to this SWZ. 3. The Ordering Party reserves the right, and the Contractor agrees to place orders without restrictions, under this contract, as well as the right to adjust the ordered quantities downwards or upwards in the event of circumstances that the Ordering Party could not have foreseen with the proviso that the minimum value of the entire contract will be not less than 30%. 4. The offer may apply to all or selected Tasks. Submission of partial tenders within individual Tasks is not allowed. 5. The contracting authority shall not allow variants to be submitted. 6. Each Contractor shall be entitled to submit only one tender. The submission by one Contractor of more than one tender or of a tender containing alternatives shall result in the rejection of all tenders submitted by that Contractor. 7. The assortment offered in the tender procedure (listed in the Price Forms) must comply with the description of the subject of the contract and must meet the conditions for admission to trading in health care institutions in accordance with the applicable law. 8. Failure to meet any of the required parameters gives the Ordering Party a basis for rejecting the offer. 9. The Ordering Party allows to offer packages containing a different number of pieces of medicinal products provided that the number of packages is recalculated and appropriate changes are made to the Price Form. In the case where the result is a fractional number after the conversion of the number of packages, the number of packages should be rounded according to the mathematical rules, i.e. below 0.5 - down to the full package and equally or above 0.5 - up to the full package. 10. The Ordering Party allows changing the form of the offered medicinal products - tablets into film-coated tablets or capsules or dragees and vice versa, vials into ampoules or pre-filled syringes and vice versa, modified-release tablets/capsules into prolonged-release tablets/capsules and vice versa. 11.The implementation of the contract will take place for a period of 18 months from the date of conclusion of a valid contract with the Contractor selected as a result of the public procurement procedure. 12.Tenders will be evaluated on the basis of the criteria described in Chapter XV of this SWZ. 13.Delivery date to the warehouse of the Ordering Party's Hospital Pharmacy - no longer than 1 day from placing the order (except for the target import for Tasks No. 19, 21, 133 - delivery date 14 days. 14. The draft provisions of the contract constitute Appendix No. 1 to the SWZ, which is an integral part of this documentation. The provisions contained in the SWZ should be treated as conditions for the award of the contract.
