1. The subject of the contract is a service consisting in the management of municipal waste (specified in parts of the contract), coming from owners of residential and uninhabited real estate and from PSZOK and the Storage Installation - the basic contract. 2. Right of option - The Ordering Party reserves the right to exercise the right of option in accordance with Art. 1 PPL - applies to all parts of the contract. 2.1. The Ordering Party informs that the option right may be exercised in full, in part or not at all, and the Contractor will have no claims against the Ordering Party in this respect. In the event of exercising the right of option, this order will be executed on the same terms as the basic order. 2.2. The Ordering Party will be able to exercise the right of option if the weights originally provided for individual parts of the basic contract are used, within a period not exceeding the term for which the contract was concluded, 2.3. Offering a longer distance will result in the rejection of the tender as its non-compliance with the terms of the contract - Article 226 paragraph 1 point. 5 of the PPL Act. Failure to indicate in the tender form the distance to the municipal installation or place of business processing waste covered by the subject of the contract will result in the Contracting Authority accepting that the Contractor offers the maximum acceptable distance to the municipal installation or place of business processing waste covered by the subject of the contract, i.e. 50 km. The distance should be measured as the shortest distance of the route by public roads (not internal roads, field roads, etc., nor do we measure a straight line) for vehicles with a gross vehicle weight above 10 tonnes. The contracting authority shall provide, within three years of the award of the basic contract, for the possibility of awarding contracts consisting in the repetition of similar services consistent with the subject of the contract awarded. The manner in which the services are to be provided will be in accordance with the rules laid down for the performance of the basic contract as set out in the tender specifications. The value of these contracts shall not exceed 10% of the estimated value of the basic contract. The value of the contracts awarded will be determined in accordance with the methodology adopted when estimating the basic contract.
